Authorization to Work...hmmm

Ok guys this might be the dumb question of the year but here it goes.

My fiance entered through NY JFK airport and I know that this airport is one of the airports that issues work authorization upon entry. I assumed I had to do something to request it which I did not. Now I am looking at the document and on the reversed side where the I-94 has an advisory regarding working without authorization and there is a section titled "Record of Changes". There we were assigned a number starting with A and it is stamped NYC EMPLOYMENT AUTHORIZATION and the date of entry.

"Does My Husband Have Permisson to Work - and Has He Had It All Along???? I know I'm a little crazy right now. Please help shead some light on this for me please!

No - the 'work authorization stamp' if even given anymore, is NOT work authorized

Unless he has an Employment Authorization document which is filed for after you marry and petition AOS, he is not eligible to work

Look at the list of acceptable documents on the I-9. An NYC Employment Authorized stamp is not on it.

I wish they would not use that stamp, it is so confusing and misleading.

Hi!

Did you already get married and send the AOS paperwork? Did you include the Employment Authorization Document (EAD) paperwork? Before your husband can work, he would need his EAD approved. The stamp is not an authorization to work, unfortunately.

P.S. He can be the best house-husband ever (until he can work outside the home) and cook arroz con habichuelas, carne, tostones, and many other Dominican dishes for you :-) Those are my plans for my fiance when he comes over...

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

LOL you are too funny!

It's called "fair division of labor." I'd rather be the one to work outside the home if he can keep a clean house, food cooked, clothes clean and put away. I need a housewife ;-) Of course, this is until he gets his EAD, in which case he nees to continue to be a good househusband and makey money!

Joking aside, there needs to be a mutual understanding of the immigration process and of the relationship because the beneficiary will not be able to work immediately when coming in with a fiance(e) visa.

Girl I hear you! My guy got here August 28th and we were planning a small wedding. Then a month later (9/30) I lost my job. We just got married on 11/12 but I'm worried about the AOS because we need an additional sponsor I think. I'm getting unemployment and I get child support which looking at $ alone a qualify but I dont know what USCIS will say...ahhhhhhhhhh I'm stressed.

I should have married and files right away.
