Hi vj,

I need help, i went through interview and the CO said to reapply the case again but he has not return my passport to me.

My husband has done the lawyer in states and she said that it will take less time now since they already have her

paper work.

i wanted to know is it true?

and how am i going to get my passport back?

Do the embassy has to send the paper work back to USCIS before i apply for the CR-1 again?

That is odd that they kept your passport... could there have been a missunderstanding, ie are you sure you need to re-apply from scratch, and not just bring in extra documents to the embassy? Did they give you any piece of paper stating why you were denied, and any options you have (appeal, re-apply, waiver etc)?

If they gave you a paper, it would be useful if you could post it here (without the personal details), so we know why they denied you and can advice you better. If they did not give you a paper, I would contact the embassy- or even better, have the USC contact them, and ask what happened and why they kept your passport.

If you truly need to re-apply, it won't be any faster really as you still need to send in the same paperwork and wait for the petition and then visa to be processed, but you can save some time as you know what paperwork you need. However, before you re-apply, you need to find out why you were denied, so you can address that issue so it won't be a problem second time around.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
