Possible source for delay/RFE???

Timeline

I am trying to use someone to help me prepare my K1 VISA, however I am worried that he is not advising me correctly.

He did not tell me to provide a written statement from my fiancee about her intent to marry within 90 days of entering the US, even though it asks for that in section 5B of the instructions. He also had me wrap my statement of intent to marry up in my statement of how we met. Is that OK? One statement instead of two?

He also didn't tell me to label the pictures like the VJ website says, although that is not a us government requirement.

Could the lack of the written statement generate a 2-3 month RFE delay???

Btw, any first hand or second hand knowledge of a delay due to missing a letter from the non-us citizen fiancee? Worried, but glad that maybe it was caught in time!

Yes, you should get an RFE. I do not know if it will delay things 2 months. Possibly not.

While it is OK to incorporate YOUR statement into how you met (IF they read it) you also need a letter of intent from your fiancee with her original signature.

There does not need to be a "statement of how you met". There needs to be an answer to question number 18 and the space provided is enough. The problem with writing more is that they really do not want to read it and once the adjusicator has established that you have met in person, they may stop rewading at line 3. If your statement of intent is on page 4, they may never see it. They want to know when (at least once) you have met in person in the last two years. That is all.

Go to the VJ sample forms and download the "letter of intent". Change the information for your names, dates, etc. You can both use the same exact wording, just change the names. email it to her. Have her sign it and MAIL it back to you with the original signature. You should do the same. WHEN you get the RFE you will be ready to answer it. DO NOT send anything until you get an RFE, if you do it WILL get separated from your file.

Supplement this other persons advice with the good info available at this site. Ask your questions in PUBLIC FORUMS not in personal messages to get as many answers as possible and to allow others to correct inaccurate information.

Labling photos is not required. I did not label the ONE photo I sent.

I also didn't include this in our packet. Our lawyer didn't tell us to. When I asked my lawyer later, she said that she never includes these (and she has done many cases like this). If later, they ask for this letter, it won't slow down your process. I'd suggest listening to your lawyer, especially if they have experience with K-1 cases.

Can your lawyer read instructions? An RFE DOES slow the case. Unless you are unaware you case sits there until it is opened and processed by an adjudicator. If the case is "all there" it will be approved. Adjudicators process 20-24 cases per day on average. If you get an RFE... that WOULD HAVE BEEN an approval if you had everything. Every day from the time of the RFE until the approval is the amount of delay. Adjudicators approve cases or send RFEs, if there is something else (a delayed background check for example) it goes to another department (this is where some of the "touches" come in).

Your lawyer's clerk forgot to get the letter of intent from you and now is covering her @ss. When you get the RFE she will say "Wow that has never happened before!" (you heard it here first). Get your letters of intent ready, the VJ samples have a proven record of not getting RFEs. I suggest you use those.

From the instructions for the I-129f petition...

Provide original statements from you and your fiancé(e) whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutual intent; and...

"original" means with an original signature...not a copy, not a scan. If you did not send one with your petition, get it ready for the RFE.

The instructions clearly ask for the 90 day intent letter, and that evidence of a relationship is optional. So I don't understand why he would say it is optional...

I'm just not willing to risk a delay because of the missing paper. I haven't filed my case yet.

OK, I was under the impression you aready filed it. Good. Then get the letter signed, the sample VJ letter works perfectly and I know of no one that ever needed any other optional "evidence of mutual intent" than the letter. Any delay in getting the letter here will be more than made up for by not getting an RFE. And then you would have to send it anyway!

To even suggest that someone could petition someone ELSE (that IS what you are doing, you know) with a fiancee visa without them agreeing to get married is preposterous. Imagine I send off a petition for some chick I met at a party, without a letter of intent they would be approving a petition for a person that didn't even know I petitioned her! The G-325a is not required to be signed by foregin beneficiaries and I could make one up for anyone and include a request it be signed at the interview! :rofl:

Thanks for your advice and all of the advice given.

I've paid the guy, but I will try to get a refund/partial refund. I called Hyunjung at 4AM last night and she was worried about the money! Silly woman...I told her to worry about delaying our wedding! :)

I will accept advice from someone like him, based on his experience, but not when it goes against the very simple instructions provided at the end of the I-129F!

Your lawyer must have plans to get some more money out of you. I'd suggest listening to the government, who put specific instructions on the forms themselves. You really should read all the forms yourself and think twice about placing the future of your relationship in someone else's hands that may not have your best interests at heart. Especially if you don't really have to.
