K-1 case status

..So I made an account for case updates right (when was it last touched..) and before that I checked for our case status using our receipt number from NOA1. So far, we're only on the second circle which is "Initial Review". and this is what it said:

"On November 5, 2010, we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283."

Anton, (my fiance) filed for our K-1 visa September this year (Vermont Service Center) So I was wondering, how far along are we? What decision are they talking about? - for NOA2? There are many stages and sometimes it can be overwhelming. Would appreciate any insights. Thanks.

You would need to give them up to 5 months from the date you filed to see any status change (that is if you are not asked to submit extra documents ie. RFE). If you are not sent any RFE, within five months (usually shorter) you would see your status as "Post-decision..." when your petition gets approved to be sent to NVC.

Hi there! Thanks for the info. So how long does it really take until I can possibly be set for an interview at (us embassy manila consulate?) Possibly 5 months until they (meaning uscis?) send to nvc and then what happens next and on an average of how long?

Thank you so much. I've been reading a lot about the processing of our K-1 visa but there's just so many information and you usually find out yourself otherwise you feel like you're kept in the dark.

Btw. I am 6months pregnant with my fiance so does it look like there's a slim chance for him and I to be together when I give birth?(Unless he comes to the Philippines?)

What would you do if given our situation?

One last thing... Why does it say that they received on November 5, 2010, the l-1296 PETITION FOR FIANCE(E) when we filed it last September?

Hello! I'm not sure why they received the petition on Nov 5th if he files in Sept....it's about 5 months from the Nov 5th date. Yes, the decision would be the NOA2. I'm not sure how long it takes your embassy to schedule interviews, but if you click on Portals up top here on VJ you can check out all the information people provided about your embassy location. You fiance will have to come to your country for the baby delivery. Also, under the K1 Guides area thee is a helpful time line so you can see al the phases in the process. Congrats and good luck!

What would you do if given our situation?

No chance whatsoever. Even if it were approved at USCIS today it is doubtful you could finish the NVC and consulate portions and get a visa issued. We have a lot of big holidays coming upo which delay everything regardless of where your case is. It is usually best, for government business purposes, to consider November and December together as "one month" Christmas and New Years are on Saturdays this year. That means that most government workers will be gone from December 23 until January 3. Most are gone the entire week of Thanksgiving. While the service centers are officially "open" I can tell you that the parking at the VSC gets mighty empty starting TODAY (opening of deer season in Vermont) until after Thanksgiving. It is a ghost town between Christmas and New Years. This is when everyone takes their vacations.

If he plans to be there for the birth, plan to be in the Phillipines.

If the child is born before you enter the US, the child will not be eligible for a visa and he will have to file a CRBA at the consulate in Manilla and get the US citizen baby a US passport. The baby will be a US citizen and is not eligible for a visa. It will also increase the family size for the affidavit of support by one person.

One last thing... Why does it say that they received on November 5, 2010, the l-1296 PETITION FOR FIANCE(E) when we filed it last September?

Because they received it November 5th. Ask your fiancee why. I presume he has a record (receipt) from mailing it. Ask for a copy.

Typically 6-9 months from the time you FILE the petition until the time you ARRIVE in the USA. Your petition was filed the beginning of November, you could reasonably expect to be in the US between May and August 2011.

Thank you so much. I've been reading a lot about the processing of our K-1 visa but there's just so many information and you usually find out yourself otherwise you feel like you're kept in the dark.

Well it all depends on the volume of cases at the time of the year you filed. Once the petition gets through NVC, it depends on the efficiency/workload of the embassy that would handle your case. My petition got to my embassy on the first week of March, but my fiancee's interview was scheduled for July ending, that is almost 5 months. Check on the case history timelines of the embassy that would be handling your case just so you can get an idea of how long it would take. There is a 99% chance you would not have gotten an interview by the time you deliver. The other 1% chance would take a miracle to pull off. Good luck!

Hey guys. Thanks for all your replies. Anton and I found out that we lost our September spot cause he was missing state birth certificate number from his birth certificate he submitted earlier.. I have a xerox with me of his birth certicifate and the state birth certificate number was left blank.. Anton had to get another original copy with the missing number and because of that, we lost our spot and got moved to November.. It's very hard to accept that those two months of sacrifice (when you think you're almost halfway there) just went to waste... But Anton and I will stick together through this. Hopefully some light soon... Anyway thanks again, guys! Appreciate all the info.

Do you fall within one of those two categories? If not then no it's not likely without a very good reason.

Hey guys. Thanks for all your replies. Anton and I found out that we lost our September spot cause he was missing state birth certificate number from his birth certificate he submitted earlier.. I have a xerox with me of his birth certicifate and the state birth certificate number was left blank.. Anton had to get another original copy with the missing number and because of that, we lost our spot and got moved to November.. It's very hard to accept that those two months of sacrifice (when you think you're almost halfway there) just went to waste... But Anton and I will stick together through this. This is not true. You DO NOT "lose spots". There is no such thing as "spots". You get a receipt showing the date they received your petition...period. That is all. The date they received the petition NEVER changes (how could it?) no matter what. If something is missing they send an RFE later.

I will repeat...USCIS DID NOT RECEIVE your petition until November 5, 2010. It is possible your Anton waited until then to get the birth certificate and mail the petition. They DID NOT return the petition to him for a Birth Certificate and you DID NOT "lose your spot". YOu thought you were "halfway there" because of misinformation you were given and you should KNOW this.

IF they ahd rejected the petition (sent it back entirely) there would be a "Rejection letter" stating the reason it was rejected and it would have been returned WITHIN 10 DAYS...that is the law. They REJECT petitions for not enclosing a check for payment or not signing forms and that is about it. NOT for birth certificates. If Anton claims it was sent and REJECTED and sent again...ask for a copy of the rejection letter.

Yes. It could take many months or even years. Then you could still be denied (most likely) I would like to know the religion that does not allow fiancees to MEET IN PERSON prior to getting married, and you need to establish that it is "strict and long established" and that you adhere to that policy in your life.

It is required that the petitioner of a K-1 prove they can support their fiancee financially. How can they do that if it is a hardship to meet?

Much easier, faster and cheaper to just meet each other.

If you expect to see any light soon, someone is going to have to be honest with you. I suggest you look to Anton for that.

Hi Rica! naku neng, you still have a long way to go, my case is already 4 months and it's still on the initial review (badtrip diba? kakaimbiyerna talaga!) although the uscis site says it will take 5 mos to process it, i doubt it, my friend said it takes longer than that. Sometimes i wonder if they are really working on it on those months that the case is still on the initial review. Hay naku, guess waiting for the NOA2 is the hardest way to learn patience. But we should never stop praying while waiting..hehe..pampalubag loob. Enormous patience...that's what i always tell myself at super kinukulit ko si Lord that we might receive it before this Christmas. I instructed my fiance though, to call the uscis at the end of the month just to check what's going on with our case because i fear that it's just sitting on shelf for quite sometime now.

Good luck girl, habaan pa ang pisi. hehe.
