DMV ID -- need help

i came here with a k1 visa.. got married last September 25, 2010 with my beloved husband.

we have our marriage license with us.. and used that to get a SSN-card with my new married name.

most of the time i have to use my passport as my id. we have tried getting a joint account today at a bank...

but the bank would only let me register my maiden name. but i will have to go back to change the name when i get a state issued ID.

we have gone to the DMW today to get an ID. i was also suppose to apply for a driver's license.

when our number was called.. the lady told me that i needed my I-797 as part of the requirements.

so we want back the same day (today) with my three (3) I-797.

1. I797- NOTICE FOR I485 AOS

2. I797- NOTICE FOR I765 EAD

3. I797- BIOMETRICS APPOINTMENT LETTER

now, on these 3 I797's

it says there that i can bring a state-issued photo id as one of the evidence of my identity.

having that said, i thought i can easily get an ID.

the thing is the lady told me i can only get an ID that has my maiden name.

NOW HERE'S THE BIG PROBLEM. I already have an ID with my maiden name on. That's my PASSPORT!

the problem is this -- IF THEY PUT MY MAIDEN NAME ON THE STATE ISSUED PHOTO-ID, THEN IT WON'T MATCH MY SOCIAL SECURITY NUMBER.

now i have also brought my marriage license to PROVE the name change.

the letters that homeland security sent me.

and my SOCIAL SECURITY NUMBER CARD that even has my current address.

i'm going back on monday (November 15, 2010) since it was already 5pm and there's not much they can do.

and i know they want to go home because it's the weekend.

so the second lady i spoke to was kind enough to help me and ACTUALLY UNDERSTOOD MY DILEMMA. the first lady i talked to was an old lady

who didn't seem to grasp the problem that i was having. she was even rude! sigh...

now, i noticed that there are 2 categories that i may be eligible to... non-immigrant or immigrant.

since my status is still pending because i have just applied for my adjustment of status... the only I797 i have are receipts.

the first lady i spoke with, told me that i would have to be granted an APPROVED I797... which would mean i would have my greencard by then.

so now i want to know, what kind of requirements did they ask of you to have a DMV state issued ID.

it's frustrating how we all try to do it the right way but there's a bump on the road.

is there any site or document that i need to see... so i can print it and show it to them.

so that i would have grounds of telling them that i have the legal right to obtain an ID from them.

otherwise, where can i get an ID?

so now i need some wisdom from everybody who has gone through this.

especially the ones that have obtained an ID without a green card yet.

In CA, the way it works is that you wait until you get your green card, in your married name. That is all they wanted to see, and the Soc Sec card.

ps, we waited until we got the 2nd Soc Sec card, in her married name.

I think it is bizarre that your DMV wanted to see your NOA papers.

And the CA ID is only valid as long as the GC, talaga.

AOS was approved in 2 months and 8 days without interview.

In CA, the way it works is that you wait until you get your green card, in your married name. That is all they wanted to see, and the Soc Sec card.

Iowa won't let you get government ID (licence or just ID) until you have a GC either. I think EAD works but honestly I just remember the GC part.

Why do you need other ID outside of your passport? Are you worried about carrying your passport around? Conflict between ID and SSN is irrelevent. My SSN is still in my maiden name and my EAD in my married. No issues.

Why don't you just wait till you get your EAD? You should be fine then. It's likely that their issue is your immigration stuff still has your maiden name registered and until you get your EAD or GC they can't match you on the system to your married name.

Yes, I would rather keep my passport at home. Aside from that, I need to send a copy of my ID with my current name.

I will wait for what the lady will do this Monday. If she has any answers to this.

I have seen other people get their STATE issued ID with just the NOAs, and yes, in Florida.

I am growing weary of the whole name change over and over again. I just want to be able to just use one name.

And not have to carry around my marriage license and passport just to prove my name. The inconvenience of it all.

They would let tourists and work visa holders get an ID just because there's a date on their form.

My husband and I think that I am entitled to an ID. It would just be sooooo easy to just have one.

So let's see it this way... i get a bank account with my maiden name. everytime you purchase something you also have to show your ID.. which in my case would be the passport.. you see how inconvenient that is? and my husband and i smoke, but i can't even buy my own cigarettes using my passport because tom thumb doesn't recognize the ID. it got me in the country, didn't it? getting a cigarette would be easy. when my husband and i go to a bar, don't you think it's silly to bring a passport just to show i'm over 21? so you see... it's very inconvenient.

aside from that, i don't think i need to justify the NEED for an ID. I can just NEED one because I WANT one.

Okay, new suggestion re the account, go to another bank. I'm with Wells Fargo and I opened it with just a passport, and changed it with my marriage certificate. OR go to the same bank and ask to speak to a supervisor 'cause a marriage licence should be fine for ID purposes.

As for the state-ID and drivers licence.. sorry but it does look like you're gunna have to wait for your EAD or GC. It's one of the biggest hassles with a K1 to you're in limbo until you're approved. You can't work, you can't leave.. just trapped.

I get the need to get it all changed. Here are the Florida DMV requirements: http://www.gathergoget.com/ enter your info on the right and it will give you the checklist. Unfortunately right now you're a non-immigrant and because you don't have an un-expired I-94 (I assume) then you can't get ID or a DL until you get your EAD. You're looking at around 2 months before EAD so Jan/Feb of next year. Sorry :(

I personally don't carry my passport around (or didn't before I got my GC). I just used my maiden name Aussie drivers licence because my passport was too valuable to be carrying around. It was a p.i.t.a. but there's the joy of a K1 :S My SSN is the only thing left in my maiden name. Everything else FINALLY got changed last month, 11 months after we got married (that's 'cause that's how long it took me to get back to Aus).

i will try tomorrow.. we went to navy federal today for the joint account. they registered my maiden name.

we are going to bank of america tomorrow, hoping to open a joint account... i have accepted the fact that i might not be able to have the card under my new name. however, i have thought of a different solution... an alternative.. but it might take a while too...

there's soooo much fuss in getting married.. and yes! it is such a p.i.t.b. :(

i am going to report/register my marriage to the nearest consulate... after which i can apply for a new passport with my married name.

i have to first send in the registration before i can personally apply for a new passport.

my passport will be expiring in a few months... in May of 2011 to be exact.

and yes i do feel trapped! i have a social security number that won't allow me to work unless i have an EAD.

my I-94 won't be of much help to me now because it will expire by November 17, 2010.

that's about 5 days from now. luckily, i did get a tutoring sideline. I am currently tutoring Algebra 1 to a freshman student near our location.

it's something i can do for a while until i can get my proper documents.

i just want to start working... all these visa requirements... cost a lot! and i don't want to burden my husband.

not to mention, just by going to my biometrics... we would have to drive 4 hours away from our city.

aside from that i have found out the nearest consulate in Florida is in Miami... about 10 hours away from where we live. :(

travelling cost gas! a whole lot of gas... not to mention the hotel expenses and food along the way.

these don't even include the fees that we have to pay to get a new passport... and to register our marriage to a Philippine consulate.

wow!! didn't think marriage was a lot of work. i knew there'll be hardship.. but i thought that was for the relationship to work.

i understand how we all have to go through this. i have accepted my fate.

but i will still go to the dmv this monday to get myself disappointed again if they won't give me an ID.

i know it will be unfair to some if I did manage to get a state-issued id with my married name with the documents that i have at the moment.

not trying to sound selfish, but i really wish that they'd give me the ID that i need.

but if not... oh well.. tough luck! i can go back and try again once the EAD is mailed to me by January or February of next year.

this is even just the AOS part... it's going to be a long journey! but i know we'll get through this somehow..

it's just one obstacle after another... and we just have to take 1 step at a time. ;)

hello..we are also living in CA...good for you at least they let you have your SSN Card with your married name...we also applied for my SSN Card after we got married last Oct..but the Social Security Admin issued me a card with my maiden name coz according to them, I need to adjust status first and have my GC before I can use my married name..so once I get my GC then all we have to do is apply for a change of name for my SSN Card...we badly need that I get my SSN card coz we won't be able to have joint account nor my husband can put me under his insurance and etc...lol..we thought that once we got married, I can already use my married name..so far, we are waiting for my SSN Card(really disappointed..)..we are still completing our documents for my AOS before my I-94 visa expires this Dec....so many things to do..hehehe..indeed, it varies in every state...God bless us all..

Before I got my driver's license, I got first state ID here in IL. I just showed my passport. And then, when I got my driver's license, I only showed my state ID and that's about it.

because with the guide.. i remember you can either apply your ssn as soon as you arrive... but will have to have a name change once you get married...

however, things can be different with each state... so i don't know...

but what's bugging me is the thought that they will issue me an ID but with my maiden name. because they said i have a passport..

and they are basing my ID from my passport. BUT there's also something in their site that says if you've recently changed your name

just bring the legal document that proves your name change... which on this case would be our marriage contract...

question for everybody: should i take their offer on getting my ID card with my maiden name.. and just come back a week after and say.. hey guess what here's my marriage contract... can you change my name on my ID please? which is actually considered a new application for a card.. coz you would have a new name and a new signature that would not match your old ID... now doesn't that seem like a lot of work? if they'll actually give me a new card with my married name.. why don't they just do it the first time? i guess i'm being silly... i got 2 days before i'll see the answers.... if it doesn't work then i just have to grin and bear it for a while.. and apply again next time... :)

Hang on, I forgot, I got my employment authorization card with me and its in my married name already when I applied for state ID. Sorry, I didn't showed my passport. It was during my ssn card application when I showed my passport.

Went back to DMV... the lady told me that she can't really do anything about it right now except wait for me to bring an I-797 receipt that I have been approved. They just want to see the word "approve". So they can either see it from either application (EAD or GC).

Hopefully I'll get my EAD by the first week of January. By that time I will apply for my driver's license instead of just a state issued ID. :) So in the state of Florida you must either have an EAD or a green card before you can get a state issued ID or a driver's license.

Weird exception to the rule though: if you're here as a TOURIST, you can apply for a driver's license and it's valid for 1 YEAR! weird huh? :blink:
