Hello All,

I am going to try to be very brief. I married my college sweet heart 4 years ago and we were happily married since. I received my permanent residency through her. I currently hold a 10 years unconditional green card that I received last year. 2 weeks ago I found out that she was having an affair to which she confessed to when I confronted her. I am considering divorce. However, I am worried that it will effect my citizenship when I do apply for it. I am not planning to apply for it now since our marriage broke apart. However, I will be applying after the 5 years mark.

1. Should I be worried that they may decline my citizenship? Will they ask me why am I no longer married during my oath?

2.What hurdles should i anticipate?

3. Can her family to get back at me coach her to lie in court that I "used" her for a green card? (Highly unlikely but I would like to be prepared)

I am devastated that my wife was unfaithful to me, and worrying about whether or not I will be able to stay in this country is adding to my stress and grief. I would appreciate a straight forward answer on this. Thank you in advance!

nope, you will have no problems after 5 years os being a LPR, just have your divorce decree before aplying for your citizenship. She can't do anything, so don't worry.

As stated, as long as you wait for the 5 year mark, no problems.

As for what happens in court.. I'm not sure what you mean.. divorce court? They can accuse all they like but you passed the requirements to get the card. They would need substantial proof to back up that sort of accusation. I think you should prepare yourself to be accused of it (by your wife, her friends/family etc). People say a lot of nasty things while upset but you need to remember that you and she at the time of applying, and the time of interview/s, passed. You're still together and the only reason divorce came up is because SHE cheated. If you were just after a GC you could have left long ago.

I'm sorry that you're going through this. But again, wait 5 years for naturalisation, no problems. Regarding the divorce, lots of nasty things might be said but without proof they're just words. Just be careful that nothing regarding immigration or whatever is on your divorce paperwork that alludes to you using her for a GC.

No, not a problem at all.... you started your marriage in good faith. That it ends... well, that happens to the best families. All that counts was the intention of why you got married but since you already passed that stage and want to apply after the 5 year mark, there is no problem at all. Just go for it. Your marriage has nothing to do with all this. You will be asked but the USCIS doesn't care, for them it's just information they want to add to your file.

Plus too add on top of what everyone else said, you now have your 10 year card meaning that you're all set to file for divorce and it will have no bearing on anything...
