When you say "pending" do you mean that the paperwork is turned in on the Waiver and you are waiting on a decision from USCIS?

If the answer is yes, wait it out and see what the decision is. You are under no obligation to "update" USCIS on your mothers death. They will adjudicate based on the facts you have given them.

If you haven't turned it in yet, its time to revisit your hardships more closely.

I have a question My husband is in the pending 601 category. My Mom illness was my hardship. Unfortunately she has since passed away. How will this affect us

Check the following link immigrate2us.net, they have a lot of info there. I do know that the petitioner would have to prove extreme hardship to be approved so I hope you can find some answers there. God bless you.

My husband just went into review status today Jan 10,2011 Do you have any idea how long this portion of the process will? Oh geez I'm really nervous now....

Not sure on this, but check on the UK forums or the Embassy website you might be able to figure it out from discussion or informatiion there.

I have another question I have been married for a year and a half. Apparently there are two types of Visas for couples how have been married for over two years verses one year. Can someone explain the difference to me.

I have another question. When my husband flew to the States. He did not check the box that says. " Did you commit a crime of moral turpitude" He was not sure what "moral turpitude" stood for. So he checked no. He was convicted of a crime 15 yrs ago. Which means he should have checked yes. Anyway we are going through the 601 process. He just received a notice from the London Embassy stating that on his 601 application he must check the box that states he acknowledges to knowingly checking the wrong box when he flew to the US. In his packet he explains in his own words why he checked no to the moral turpitude box.Which to me is acknowledgment. Anyway Is this just a formality on the paper work? Or is this another long term problem. If it is a formality. Do we go back to the end of the line again?

I hate to be the one to tell you this but USCIS sees the failure to check that box a misrepresentation, for some reason. I think its pretty common folks don't know what moral turpitude is.. alas though I know of someone who was in fact accused of fraud for this same issue. Hopefully it will turn out better for you, or if you still have time and they accuse you of fraud or misrep on top of the I601 other issues, you might be able to ammend the packet before they adjudicate it to deal with that as well.
