Ack, and another paranoid question. Before I had decided to fill this stuff out on my own, I was using a paralegal to assist me.

Under "This form is submitted in connection with an application for" ...On my wife's (the Beneficiary's) G-325A Form, he checked off "Other (Specify)" and wrote "I-130 by my husband, NAME". Is this correct? Or, should I check off "Status as Permanent Resident"?

The paralegal did it correctly. Your own G325a should be checked and noted the same way. You are submitting the G325a in connection with an I-130. I generally recommend simply "I-130 CR1 visa."

The foreign spouse's passport copy is needed at the NVC stage. If she's changing her name, don't send the one with her maiden name.

Your signature can be anything you want it to be including illegible. What "it" is it you are asking about, that they added a name or how you signed your name.

Is it okay to sign and date the I-130 in blue ink? As well as for the G-325A Forms?

Also, on both forms, I hand-wrote a word or two in blue ink. Is this okay?

I ask because on the I-130 General Instructions, it states:

1. Type or print legibly in black ink.

Would they make a fuss?

Again, no worries. I recommend signing in blue ink anyway. Signing and filling out are not the same thing.

No, they do not "let you apply for it". USCIS will let you follow your I-130 filing with an I-129F for spouse, put your I-130 back in line with the I-129F, effectively delaying the approval of your I-130 and then approve them the same day and send them on to the National Visa Center (Dept. of State) where NVC will promtly "administratively close" the I-129F petition that slowed down your I-130 processing. Applying for a visa is something you do with the Dept. of State and DOS will NOT allow you to apply for the K3 (or K4) visa the I-129F was filed for to begin with.

USCIS doesn't issue visas. Let that sink in. You NEVER send a "visa application" to USCIS....BECAUSE....

USCIS doesn't issue visas.

I have all the paperwork together, I've read every word of the instructions and feel confident I understand them. Reading everything you've written on this thread has just been reaffirming that I have everything correct.

However, the fact that the K3 is obsolete is news to me. It's good to know. In the post that I'm quoting, are you recommending that we do not submit an I-129f at all?

Also, I would like for my wife and son to be able to visit sometime during the immigration process. This would not be for them to stay permanently at this time, just to visit. Would that be possible? I had the idea originally that the K3/K4 would allow that, but I'm guessing that's not so. What could be done, if anything, to allow a visit?

Thanks!

That's correct. Submitting an I-129F for a spouse cannot help you but will probably delay the approval of the I-130.
