Hello to All,

Sorry if my post is a redundant one, but my head is spinning from reading far too much on the subject.

Here is our current situation:

We live in Canada. I am Canadian, my American husband lives here through permanent residency. We live just outside of Detroit in the Windsor area. My husband commutes to the U.S. every day for work. We have two daughters, both in University, one is 18, the other almost 21. We were married in Illinois 7 years ago. Do I have to apply for a K3 before going to the U.S., or can I do so once there. Obviously it's quite easy to get over the border, I do it now at least once a week. However, I don't want to do this under the radar, but if I could apply once over there, then that would be great. Is there a timeframe that I cannot return to Canada? Again, I apologize if my questions are "amateurish", but honestly, I can't make heads or tails of this process!!!

Visas are used to enter countries so are not applied for after entry. The K3 visa is no longer available. The spouse visa applicable to you is the IR1. Click on the word "Guides" above and study carefully. If your husband resides in Canada, you are probably eligible to file the petition directly with the Consulate so see that Guide as well.
