How do I know if I need the I-864EZ or the long form? I have no equitable assets to add to income.

I have the following:

My tax transcripts for 2008 and 2009 and W-2 and IRA 1099 for 2009. I have been consistantly employed for the past 5 years.

All my 2010 paystubs along with a letter from my current ewmployer to validate my employment.

Do I need anything else?

My gross income was above the poverty guidelines since 2008 by $5-$8K. So even the poverty level increases in January, I feel comfortable that my income is need.

Do I need my bank records if I have had direct deposit?

The child support for the past two years have been irregular, but not included in my total income. This can add maybe $1K to my gross income. Since the child support is irregular and low, if I send those printouts from the family court, would it cause a red flag?

I feel like I need something else, but i am not sure.

Please give me your input.

Go for I-864 regular form.

I am not sure which you mean. Please specify.

The regular I-864 is fine...as long as you meet the 125% you are fine, more isn't an advantage. Keep it simple and you will fly.

May love and laughter light your days,
and warm your heart and home.
May good and faithful friends be yours,
wherever you may roam.
May peace and plenty bless your world
with joy that long endures.
May all life's passing seasons
bring the best to you and yours!

Rather than I-864EZ, go for I-864.

Smell your case bit complex to handle I-864EZ.

If you have paystubs, include those with the employment letter.

If you don't have regular child support income and if it is minimal, don't include them.

You will qualify I-864 if you meet all the 3 below points.

1. You are the person who filed or is filing the Form I-130, Petition for Alien Relative, for a relative being sponsored;

2. The relative you are sponsoring is the only person listed on the Form I-130 petition;

3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s).

Thank you again. I want to be sure of what to do so I do not make simple mistakes that could delay our process.

You will not need to show your direct deposits. Your transcripts are enough. By the way....K-3 is considered a CR-1 if you filed an I-130 and married in Morocco.

They will also refer to your case as a CR-1 on all your documents you will receive from USCIS and NVC. Make sure to write both your names along with your case number and CR-1 on all your papers you mail back including transcripts or anything you send in at the top right hand corner....Looks like you have everything in order!
