Yeah I know its my fault

OK, before anyone says "Its your responsibility" or "How could you forget something so important?" I know. I know I know I know. I have kicked myself 3thousand times since we got a letter from USCIS yesterday in the mail. I have run around like a crazy person getting everything together, and writing a heartfelt apology and explanation as to why, in November we are just realizing what we didn't do. My husbands card expired in June 2010. June 25 to be exact. Tough year?? Ummm yeah. Suicide attempt by myself (3rd time) and being hospitalized. Rheumatoid Arthritis becoming more crippling as days pass. Medical bills piling up. Everyone trying to keep me from falling into despair. Quite frankly...it was pushed to the back of our minds. We had discussed it in February as we were considering heading back to England...but aren't doing it anytime soon(we still might...and he may have to). We knew we could file in March...but in February my life fell apart.

How has everyone else that has been in this position faired? I am a wreck. If I don't end up back in the hospital again....I'll be lucky. I have tried to contact an attorney, but money is so tight. I'm thinking I'm just going to file the petition with all evidence I can get my hands on today and tomorrow (everything is closed tomorrow anyways) and head to the post office first thing Friday morning. Hope and pray....and keep taking my anti-anxiety meds. I seriously hate myself right now. :bonk::crying:

Late ROC petitions can be accepted if you can establish a good reason for untimely filing.

From INA sect. 216 (The ROC section)

(B) Date petitions for good cause.-Such a petition may be considered if filed after such date, but only if the alien establishes to the satisfaction of the Attorney General good cause and extenuating circumstances for failure to file the petition during the period described in subparagraph (A).

I am not sure if establishing a good reason entails merely explaining in a cover letter, or requires something more, but don't panic! Good luck!

All you can do is try and explain your situation. Oh and do not leave the country for any reason while all this is going on. Even when you receive the extension letter (NOA1).

Well, seeing as I have THOUSANDS of dollars of medical bills, an attorney really isn't an option. And the only documentation I have is medical records...and I can't get those without a wait of at least a week. I am just going to have to send what I have and hope for the best. If they ask for more information...then I will get it for them. My main goal is to get it in the mail without losing my mind in the meantime. But I don't want to wait any longer than I have to. They need to speak to my doctors...by all means. I can give them their numbers and they can give them a call.

That won't happen. The onus is on you to supply the support to your argument/request. It is not the role of the adjudicator to do the digging.

Without the proof of good cause or extenuating circumstances you will not get the desired outcome.

Take enough time to prepare a pursuasive arguement and your request stands a much better chance to be granted.

I understand its on me...jeeze, but at the moment what I am saying is, I am sending what I have...and what I have is a letter of explanation. If they want or need more I can give it too them. Medical records, doctor's phone numbers, prescriptions, copies of medical bills.ETC

Waiting the week to get the medical records would probably be worth it. No-one's going to appear on your doorstep this month demanding to deport your husband, so you can afford to take a week to submit a full petition.

Certainloy aint your fault, don't blame yourself. It would be your husbands fault as it is he that is trying to remove conditions and he should be responsible enough to know what his status is and what he needed to do.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

What letter? Does it say he's now in removal proceedings?

If you want to file something without worrying if they'll accept it why not just file for AOS for him? ROC evidence should cover the AOS with the exception of an updated Affidavit of Support.

No it doesn't say he is in removal proceedings, just that he never filed and his status has been revoked. He does hold some responsibility too, but he has been so busy trying to keep the money coming in to pay the medical bills, and helping me, that I'm sure he never even realized.

Just found all my bils, my discharge papers from the mental health center, my paperwork for my disability hearing that is coming in January, letters from our insurance company and such. Going to make copies and send all that as well.

You can send the package in and risk a TOTAL denial, OR wait a few days and send your records in and give yourself a better chance.

I know which one I'd do.
