I am US citizen for few years. I want to bring my mother here. Please suggest should I get her on Visitor Visa or on Green Card. The reason I want to start with Visitor Visa is I am not sure if she is going to like staying in US for long time or on permanent basis. This way once she comes on visitor visa and likes to stay here for long time or on permanent basis I can apply for her green card then. If I start with Green Card and if she doesn't like then much of the purpose for going through the GC process will be sort of wasted. Please advise.

My mother is 65+ years old and has some property in her name. I am all here by myself and soon be joined by my would be spouse. Rest of my brothers , sisters and their kids all are in India. I gave all these details so you know some history and then advise me.

I would start with the B2 visa... if she visits and doesn't want to stay for good she could go back and visit from time to time,and it would save you a lot of $$ in the long run not filling for AOS and then having her decide she doesn't want to be here.

AOS From B2 Journey

8/13/10: AOS Package Sent

8/16/10: Package Received at Chicago Lock Box

8/26/10: Checks Cleared and Case Transferred to NBC

8/30/10: NOA Text/ Email and Hard Copy

8/31/10: Case Status Appears On USCIS Site

9/9/10: I-130 I-485 I-765 Touched

10/5/10: Called USCIS abt "No Bio Letter" / Service Request

10/13/10: Hard Copy Service Request

10/20/10: I-765 I-485 Touched

10/21/10: I-765 I-485 Touched Again :-)

10/23/10: Biometric Letter Received For Nov 15 App

11/15/10: Biometric Appointment

11/15/10: EAD Approved..... I-485 & I-765 Touched

11/19/10: Card Production text and email received again for I-765. I-765 Touched

11/23/10: EAD Received

11/29/10: Applied for ID and SS card

12/04/10: SS card and AOS Interview Letter received

01/04/11: AOS Interview..APPROVED!!!

01/13/11: Green Card Received

10/12/12: Package delivered to VCS

10/17/12: Check cashed, but no NOA1 yet.

You dont apply for a tourist visa for her. She does in India. She will have to provide proof of strong ties to India that will require her to go back. If they feel she is going to attempt to stay " a long time" she will not be issued the visa. It can be difficult to get a tourist visa from India. The only way to know for sure is to have her apply. To succeed she must understand the rules used to allow the issuance of the visa. See the embassy web site for info about tourist visas.

The time she can stay is determined at the point of entry by the officer on duty when she enters. If he thinks she will not return in that time frame he will not allow her entry.

You as a USC can petition to bring her here as an immeditate relative. See the USCIS site & you will find an area where you can input some basic info to get an idea of how long it may take to get her a visa.

Thanks for the reply. I forget to say that way " My mother will be applying" . I am filling all the forms and everything on her be half that's why it came out like that.

I would suggest starting with a visitors visa, then if she likes it, move to the green card application.

Now as she is a senior I recommend adding on top of the normal requirements (Deeds, Bank Statements, etc) a copy of her health insurance and highlight how important is that for a senior person. Maybe add a letter from her doctor where he asks her to come back for a checkup.

In the same way, as you are US citizen; you could write a letter in which you explain that she only wants to visit you, and she is not planning to stay in the US. if she would like to remain in the US, you could sponsor for a green card which she could get in a few months as a close relative, but you consider is no adequate for her as she only wants to visit and come back.

I believe she has good chances in getting a visa, but all depends in how you present the information. Good luck

I think you should start with B2, I dont see any reason for her to be denied at all.

She is 65+ and even is she does not show strong ties to her home country, she will be granted a 10yr visitor visa.

She can stay here for 6 months and check it out, if she likes it here or not, and then she can always come back on that 10 yr visa.

Since you are USC chances of her being getting rejected on B2 are very slim.

With India even CO office knows most parents dont overstay the visa in usa, they return back to India where most family and friends are.
