Hello Everyone,

I am Canadian and my Wife is American. She is sponsoring me, we have 2 kids but she is not working. She is living with her Mother in US. I need help to fill i-864

here is our situation!!!!

her mother is signing as co-sponsor since my wife is living in the same house hold. My mother in Laws income is 22,000 which is not enough to cover 125% poverty level. we are total 5 members of household. my mother in Law, my wife, two kids and my self.

we are also adding joint sponsorship. He is my wife's uncle. He have 3 dependents..his daughter, son in law and grand daughter and his income is 31,000 so total household member including me will be 5.

1) i need to know if we should add 22,000 plus 31,000 and I will be fine to have the support.

2) I should be added twice on both forms i-864A for co sponsor, and i-864 for joint sponsor.

any help is appreciated.

Just a little confused, how can the mothers uncle's Son-In-Law be classed as his dependant? You should be fine with both as sponsors but at the same time what are the ages of the dependants? As for which form your name needs to appear on, its both. A joint sponsor may submit an Affidavit of Support to sponsor all or some of the family members if the primary sponsor does not meet the income requirements. A maximum of two joint sponsors per petition can be used. Each joint sponsor is only responsible for the applicant(s) listed on that joint sponsor’s Affidavit of Support.

Call the National customer service center 1800-375-5283 and ask them about your concern...

Did your MIL claim your wife or children as dependents on her most recent tax return? If not, then she could submit an I-864 as a joint sponsor. Household count would be 2 (MIL and you).

Now the adjudicator may see that the address on your wife's 864 and MIL's 864 are the same and want more income. They do have the final say. If so, then you will need more income and/or a different joint sponsor.

Uncle's income has to stand on its own. Cannot be combined with your MIL's income.

Did the uncle claim his daughter, son-in-law, and grandaughter as dependents on his most recent tax return? If so, they are included in his household count. If not, they would not be included in his household count.

thank you for all the suggestions

uncle have all of them as dependent on his last year tax return. I wanted to know if I will be fine with income requirement. and if we are filling i864 in December 2010 then we should use poverty level for 2009 or 2010.

another important question

will I be count twice in i-864 on sponsor's form as well as on i-864 joint sponsor form.

Poverty income amounts have been the same for 2009 and 2010. 2011 will not be issued until March or so of 2011.

Your wife will include you in her I-864 affidavit as she is the primary sponsor even if her income is not enough.

The uncle will include you in the count as well on his I-864 along with any of his dependents.

Your wife's household will be 4 (her, 2 kids, and you). Income requirement = 27,562 Wife's income is zero. Some sort of joint sponsor needed.

Did your mother-in-law claim your wife and the 2 kids on her last tax return? If yes then the household size would be 5 and the income ($21,000) is not enough. If she did not claim your wife and kids as dependets then she would complete the I-864 and have a household of 2 (mom and you). Her $21K is enough for 2 person household.

Uncle's household will be 5 (uncle, daughter, son-in-law, grandchild and you). Income requirement = 32,237

The uncle's income cannot be combined as a household member.
