Received my RFE letter...please help

Hey Everyone,

SO finally I got my RFE letter in the mail today..... It states

SUBMIT a complete Federal Income Tax Return submitted to the Internal Revenue Services (IRS) from the petitioner on

Form I-864, Affidavit of Support, for the most recent tax year (2009)

So I did send the W2s for all the past three years. ...so I'm confused on what they want me to send them??? :wacko:

PLEASE help.....

09-28-2010 AOS Packet Sent

10-11-2010 NOAs received (I-485,I-130,I-765)

10-13-2010 *touch*

12-09-2010 Case transferred to California Service Center

**No Biometrics letter recieved yet ( over two months waiting

12-16-2010 Biometrics done!! (NO walkin. Got an appointment letter

earlier in the week from Dallas bio office.

12-17-2010 Got email EAD being sent!

12-18-2010 Got AP in the mail!

12-22-2010 Got EAD in the mail

W2 is nothing without the tax return

You need to send his tax return or tax transcripts for the year 2009.

Sounds also like they want you to redo the I-864 as well. Not sure of the wording on that tho.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

You can get your transcripts in no time by going to your local tax office or calling them. We called and they faxed us the transcripts straight aw.ay (really!)

w2's aren't tax returns. They're basically year to date earning reports from employers, and reports of tax withheld etc. They are submitted WITH your tax return

You can either send the tax return itself, OR to be on the safe side contact the IRS to get a tax transcript. They're free and should arrive in less than 2 weeks unless you have a fax and then it's quicker.

So my husband was able to locate his 2009 tax return from turbo tax. The form is called 1040. Is this the same form I would get from the IRS? I will be sending this out tomorrow.

Or should I contact the IRS tomorrow morning for the transcript???

Please advice me asap!!

If you get the transcript from the IRS then that is all you have to send. If you send his tax return from Turbo tax then you will also have to make sure that you send every W2 and other form related to the tax return. If his taxes were simple then that should be simple to do.

Most people use eFile these days, so they have no idea what forms they would have to file if they actually filed a paper tax return. Fortunately, TurboTax knows. You can have it print out a complete tax return, including all schedules that would be required. It will also provide a list of any supporting documents you would need to include with a paper tax return, including any W2's or 1099's (it knows which of these forms you entered information from). If you decide to use TurboTax to print a paper tax return then BE SURE YOUR HUSBAND SIGNS IT! USCIS policy requires that the tax return be signed. The copy you send to USCIS must be an exact duplicate of what was sent to the IRS, or would have been sent if a paper return was filed.

Getting tax return transcripts from the IRS is less complicated, and less prone to error. Follow the instructions here:

If you get an actual human being on the phone then you can get them to FAX the transcripts to you the same day. Your husband will need to know his Social Security number, and the Adjusted Gross Income that was entered on his last tax return (for identification purposes). If you have access to a FAX machine then I recommend this route as you have a limited amount of time to respond to the RFE.

If you send transcripts to USCIS then you don't need to include W2's or any other supporting documents.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
