When do we have to take our decision?

Hello again,

Some JV members told me that even if BOTH I-129F & I-130 are approved in the same day (yesterday), it's still early to choose "one" of them!!

Plz, can anybody tell me WHEN EXACTLY do we have to take our decision? i.e K-3? OR CR-1?

And i've read somewhere that a person can enter the US, and stay for a couple of weeks and then come back to his/her country to take the CR-1 interview? Plz I need more explanation about this choice? ... well, if it's option really possible, of course!!

i'm really confused, we want to understand the different choices a couple can have... so, i need your suggestion at this moment of dilemma :help:

thanks in advance

You now have a choice as to how you wish to reunite with your spouse and obtain immigrant status.

1. Interview for K-3 whereby you will adjust status in the US.

2. Interview for CR-1 which will give you immigrant status on entry. No AOS, can work & travel straight away. Nothing to do until 90 days before the 2 year anniversary of entry to the US, when you will apply to lift conditions.

3. Interview for the K-3, enter the US and then return for the CR-1 interview. Many choose to do this as AOS can be a royal pain in butt and can take up to a couple of years to complete. If finances and situation permits this is often the best choice.

The I-130 through NVC is going to take approx. 2-3 months depending on if you use James Shortcuts and on any hold ups with the background/security checks. If your I-130 reaches the consulate prior to a K-3 interview it will over-ride it in the majority of cases. Do you know what the wait times are for the consulate interview will be held?

thanks aussiewench for your answer.

i think that the choice #3 will be good for us... but i think that we need to see what will happen in the next couple of weeks.

no, i don't have a clear idea about the wait times for the consulate interview in Casablanca... i think for K-3, it's between 1 to 2 months... i still need to check!!

Damm, sorry I should of looked before I started writing that last post and I would of known you were Morocco. In your case I wouldnt advise going back to do the CR-1 if you are granted the K-3. Morocco is a b!tch of a consulate and there has been many denials. Going through one interview there is enough. Check out the morroco threads in the Regional Forums section.
