I have 2 friends who are about to embark on their Visa Journey... I wanted to get some opinions from y'all. Here are some details of their case:

The husband is the USC and the wife is from Russia.

The husband is 34 years old and the wife is 22 years old.

The couple met last year (2009) and were dating - she was in the US and returned to Moscow for a few months .. she recently returned to the US on a B2 visa and they wed a few months back.

They do have a bona fide relationship and marriage and can show this thru correspondence records, etc.. joint accounts..

The husband is employed but his income is limited. They *may* need a supporting sponsor - this remains to be determined.

I know that USCIS can sometimes scrutinize relationships with an age difference, and those from certain geographical areas of the world.

Do they have a good chance for approval????

Also, on the G-325A they ask each to list their employers for the past 5 years. The wife had worked in the US on a past J1 visit a few years ago.. she did not file a US Income Tax Return and is concerned about listing this employment. Any advice on that front?

09-29-10 4th service request to USCIS, useless convo with IO

09-30-10 AP received and signed by USCIS, J.Chyba

10-04-10 Another useless convo with IO

10-06-10 Letter sent to Congressman

10-10-10 Letter sent to Senator

10-11-10 AP Touch

10-13-10 Email received, AP approved :)

10-15-10 Useless SECOND Infopass appt. and useless AP without biometrics

10-16-10 I-512L AP Doc arrived in the mail

10-18-10 Another USELESS call to USCIS

Based on what you've written I think they will be approved. The tax return should not be an issue. As an accountant my belief is most students that do not file tax returns are forfeiting any excess taxes withheld. If they are worried they can call a local CPA for a quick phone consult to make sure.

All looks good except for the time she worked in the US, if she made less than 7 thousand dollars during that tax year, she is not required to file taxes. :thumbs:

The "rule of thumb" that I have been told from several sources is only if it is more than 15 years age difference do they start to question it and it depends on the age of the two in question. Obviously someone who is 60 marrying someone who is 44 will raise fewer questions that someone who is 40 marrying someone who is 24. In our case there is a 16 year difference but it hasn't raised any issues yet. 34 to 22 may raise some questions, but it shouldn't be too big of an issue to overcome.

Thanks for everyone's input! It's great to get other opinions of the case :) Yes, she definitely made LESS than $7000.. way less! And on paper, 34 vs 22 may seem like a big age gap but these two really couldn't be better suited for each other! (L)

FWIW, you can always file taxes after the fact. In her case, she might want to do that. She'd get all the deductions back for having such low income.
