hi, I understand that most VJ people say an attorney is not necessary for the I-129F petition. I agree, because I am disappointed by our attorney as well. but what about the AOS? is the AOS more difficult? will I need an attorney for it?

To me, the visa petition is the hardest and most stressful part of the process because everything hangs in the balance there, not to mention it requires more documentation. So I would say, DO NOT hire a lawyer for the AOS process. It's really straight forward and the most defined by USCIS, in my opinion. Good luck!

Read through the guides at the top of the page. Read through the forms you need to fill out. Can you follow those directions, or do you need someone to walk you through them? Then you should be able to answer your own question.

We don't know much (or anything) about your case, so there is no definately answer. If you have extenuating circumstances, perhaps a lawyer would be of help.

For us, however, we read the guides, read the directions and did it all ourselves. Nothing tricky about it at all.

I ran into a situation in my own case. My wife right now is stuck in Europe (Austria) due to a family tradegy and cannot leave.

She will miss her AOS interview. Made an info pass and talked to them. Im powerless to ask for a delay as Im not the petitioner nor am I the attorney (which we dont have).

The petition will be automatically denied due to the no-show. She has an AP document and will re-admit her into the US and we need to start all over again with the I-485 with all the same paperwork again.

Its logisticially impossible to get an attorney on the record in time, and to me its just easier to start all over again. \

Other than that....an attorney does not have much to offer at this stage....just provide the info they need when they schedule the interview.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

If you did the K-1 visa process without an attorney and your case is simple you do not need an attorney. Just read the guidelines and follow them. :yes:

If you did the visa on your own the AOS will be a breeze for you. I would say 'NO' to using a lawyer.

In fact I would recommend it personally, as friends of mine who have gone through this with lawyers generally had very negative feelings about their lawyer experience.

The forms are really quite simple. Given how much it costs to file, I can't recommend shelling out more on a lawyer unless you have a complicated case.

Files in a law firm are probably no different than files at the USCIS - papers exchange hands so many times that it's hard to tell if something is lost until it's too late.

We did hire an attorney for my AOS, because we were too afraid to make any costly mistakes. Also, we were a little worried, because I entered the U.S. as a visitor, stayed and then married my husband. As well as I 'overstayed' my visitor status, so we wanted to be sure. But now having gone thru it and having been approved, I know that we could have done it totally on our own. Oh well, expensive lesson learned...lol.
