No problem, it was something I found irritating when I read about it. In my opinion family based petitions should take precidence over corporate ones. Additionally if they can expedite them that quickly it would seem that the delay in family petitions is not because of background checks.....or they aren't checking backgrounds on work visas as intensly as they are family based ones which ....IMHO would be a threat to National Security

Plus for the unmarried folk? Shouldn't this waiting period then be applied to all US citizens wanting to marry?

Exactly! I complain about this process to my family and friends and when some of them bring up the topic of 'testing commitment' I ask why their own marriages were not tested first? What makes 2 US citizens a better fit than a US citizen and someone from another country? What difference does it make where my future spouse is from? Don't get me wrong, I can understand a slight delay for background checks and scans for visa fraud but the current process is absolutely unreasonable in scope and timeframe.

No one doubts your intention to marry your fiancee. US government however sees fake marriages, engagements all the time. They doubt the intention of the alien fiancee. Unfortunately with an engagement their is no written or documentary proof of its validity. So how can it be evaluated if the engagment is real or not. Honest and good folks are lumped with with the same. I dont see how 3 mths waiting period is too long. Even colleges take months before they decide on an applicant. Jobs offers take a couple of weeks. More applicants then enough people to handle the task. so the extended waits.

Hmmmm, fake marriages, let's see, do they happen to a U.S. citizen marrying another U.S. citizen, NAAAAAA! But wait, let's look at blondie that married for love (yeah right, love of MONEY), what was her name again, oh yeah Anna Nicole Smith!!! Gee, and the U.S. government goes after U.S. citizens accepting cash donations from fiancee's/spouses overseas.

No, I'm not marrying for money nor is my fiancee marrying me for money, if this were the case I'd be living in China at this moment. Love conquers all including lost time with the one that you truly love!!!! I'll wait as long as it takes to finally feel my soulmate, my life partner, my best friend, my Xiang in my arms once more.

I look at it this way, another day over, another day closer to her being here with me for all of eternity!!!!

Thanks,

Keith

"The wait is not you tob with your love. You can fly to his or her country and be with your love. The wait is for them to enter US. The wait is to ensure that you can take care of them in US, they dont have any criminal background and they are safe for the community they are going to live in. What do u think is the proof of a long standing relationship. You may feel strongly in the proof but the USCIS has to evaluate those. So the wait."

Sure, every single one of us can take the time off from work, dip into our bank accounts, apply for the visa to visit the country where our fiancee/spouse waits patiently. The vast majority of us cannot take the time away from work, heck I have to balance the civilian side AND the military side of my life. Do you know what it's like being in the military during this time in our lives, Chaotic!!!!!!!!

But you forget one thing, actually two things, LOBBIEST and the extra $1,000.

What I would really like to know is this, why is it that a company or corporation can pay $1,000 to have a workers visa rushed through while the K1 and K3 visa's get pushed aside?

I have no proof of this, but my guess is that even when a corporation pays for an expedited work visa, it doesn't really get expedited (after all, how would the company know what timing is "normal" and what timing constitutes "expedited"). Unless work visas are handled by a service center on fantasy island, it seems very unlikely that they have the staff or the competence to actually expedite anything.

Actually for the expedited work visas that the company pays 1000 for, I believe I read USCIS guarantees to adjudicate the petition in 15 days

Premium Processing Service provides faster processing of certain employment-based petitions and applications. Specifically, USCIS provides 15 calendar day processing to those who choose to use this service or USCIS will refund the Premium Processing fee and the relating case will continue to receive faster processing.

The processing period that is used to determine whether or not USCIS meets the 15 calendar day period will begin when the current version of Form I-907 is received by USCIS at the correct filing address noted on the form. Within the 15 day calendar period USCIS will issue an approval notice, or where appropriate, a notice of intent to deny, a request for evidence or open an investigation for fraud or misrepresentation. If the notice requires the submission of additional evidence or of a response to intent to deny, a new 15 calendar day period will begin upon the delivery to USCIS of a complete response to the request for evidence or notice of intent to deny.

Premium Processing

Wow, I just read who qualifies under Premium Processing, I truly believe that anyone in any country could qualify. As long as a company or corporation is willing to shell out $1,000 then the immigrant can come on over, provided of course that they pass a background check, I think.

I will guarantee to you that expedited for a work visa is truly expedited: 2 weeks. I can remember AFTER 9/11, in 2002 that the foreign employee could be in the US within 2 months. That is truly expedited.

I agree, they do not need to bring in anyone with special skills. To the best of my recollection, I remember xxxxxx not hiring Americans because they could birng in someone from Australia for less cost. It was, and probably is, always about the cost. I am sure this happens in a lot of industries where the companies are big and they have a global workfoce.
