hey columbus!!!

im finally glad to meet someone n my same situation...

my husband came on a k1 in 2000, got divorced before the 2 years were up..in april 2002. we got married in 2003, and we had a child in 2004.

now he as been in the US all this time. BECAUSE- he applied for an i-751. petition to remove conditions on residence. he got that in june 2002. he got it again renewed in june 2003. these were sent on "notice of action" papers, enabling him to work and travel abroad. he keptasking about his i-485 staus via SEVERAL infopass appts, all times he was told his status is pending. we even have a written notification from an immigration official saying his status is pending.....in december 2004.

he gets his 2nd interview -- from that first marriaged based-- on NOVEMBER 18, 2005.

there they tell him his i-485 was denied in sept 2002. 3 months AFTER they grant him the i-751.

he left back to india on nov 19, and we started the k3 visa process---

I USED HIS PREVIOS ALIEN NUMBER AND SOCIAL SECURITY NUMBER ON BOTH THE I130 AND I129F.

MY QUESTION IN THE FORUM WAS DID HE OVERSTAY-- THEY NEVER LET HIM KNOW, AND THEY PERMITTED HIS STAY TILL THEY CROSSED OUT HIS STAMPS IN HTE PASSPORT ON NOV 18, 2005....

IVE GOT THE NOTICE OF RECEIPT FOR I129F.. WAITING FOR APPROVAL

MY QUES TO U IS-- DID U STAY IN THE US ALL THIS TIME? AND JUST REFILE THE I-485?

OR DID U GO AND COME BACK BY FILING FOR THE K3 VISA?

OH IM WAITING TO HEAR FROM U!!!!

since he first started with K visa maybe it's necessery for him to go back and start over. did you gain info about K type of visa status? i have never involved with K visa so i don't have knowledge about it. in my case it would be difficult to go back and file fiancee visa(maybe faster though) since i am kind of settled here with mortgage payments, cars etc. i know it's going to take years again but nothing to do. for me it's seems ok to file I-130 , etc again.
