I filed as an adjustment package after marrying my American Husband. We are currently living in Florida and we recieved notice of our Adjust status Interview

Im not worried about being able to prove the bonifides of our marriage we are confident that we can prove this my problem is the included paper that says;

If you have ever been arrested or detained by any law enforcement officer for any reason, and no charges were filed, Bring:

- An Original offical statement by the arresting agency or applicable court order confirming that no charges were filed.

I was in the wrong place at the wrong time when I was 16 with 4 friends that got arrested for a stolen car. I did get picked up with them and taken to the police station fingerprinted and questioned, however since one of them had keys to the stolen veichle and I hadnt even known it was a stolen car, me and my bestfriend were sent home with our parents for being in the wrong place at the wrong time, they didnt give us any sort of paper work we never went to court, we never heared anything about it again.

Ive called the Toronto Police but they were very unhelpful, they basically said they cant provide this and since I was a minor and it was more then 10 years ago there shouldnt be a record, the only thing I can do is apply for a Clearence Letter from the RCMP, which takes months, its some new system canada has put in place but my appointment is on December 6th I only got a months notice for my appointment date. Or I need to appear in person to a toronto court to have them sign a letter that I have never faced any charges to the best of thier knowledge, but I havent been approved for a travel document by USCIS yet.

Im very nervous I dont want to LIE in the interview,then have them find it in a background check even though the toronto police are telling me that they wont find anything since I was a minor. But I also dont want to tell them about this incident and not have the paper showing I wasnt charged.

Please help does anyone know how the USCIS handles cases were the person only has a sealed JUVINILLE record?

Are you adjusting from tourist or from a k-3 visa?

Well I had entered the USA on March 14th as a visitor, I had just been laid off from my job and I told them that at customs, also that I was intending to marry a us citizen but my plan was to return to canada and look for work again while the immigration process took place.

However after our wedding my husband got a promotion and a raise and I called USCIS and told them about our situation and they told me as long as I filed the adjustment package I could stay.

So I guess you could say I filed as a tourist, however I did it as legally as possible.

Life was throwing us a ton of curveballs nothing happened as originally planned.

Edit: to have this make more sense I mean I could DRIVE from my canadian home to his but I was living with my mom in canada, so they didnt question that I planned to return they saw me weekly at the boarder they knew me by name before seeing my passport lol

Not saying you had done it illegally =) just asking what point you are at in the process and what point you are coming from.

If you had gone the rout of obtaining a visa you would have to provide a police certificate from canada for any of the visas ( fiance or spousal )

Also you posted in the K-3 section not the adjustment section =)

as for needing a police certificate in your case I - THINK - you might but im not totally sure..

Living in canada the Police check only takes maybe 20 mins and you walk out with it in your hand. Living outside of canada you have to request finger print check which can take a few months to get results from. In the canadian section there was someone who used a website to get theirs done while living outside canada and it took them 1 month with that company doing finger print check but Im sorry I cant remember who or what the website link was..

maybe pop over to the canadian section and ask.
