while the 129F is being processed, is there any way that the alien applicant can cross the border? or is it only the US citizen who can cross? are there any exceptions (if you have extenuating circumstances) that the alien can cross? ie: the US citizen's fnancial situation (can't take off work), major health issues (going in for surgery), etc.

Hi.

The Canadian fiancé can cross into the U.S. However they do have to realize they will face some kind of scrutiny at border crossing. If the Canadian fiancé wants to cross, they will have to show some kind of proof that shows they have ties to return to Canada... some proof that can be shown is proof of lease/rent/mortgage, letter from employer that the fiancé intends to come back to Canada and return to his/her job are just a couple.

If you search the forums there's a bunch of threads on this (I know because I made one :lol: )

But basically the answer is yes.

Your USC Fiance is certainly able to visit you and you are able to visit him/her...

BUT

Both of you (more importantly the alien fiance) must take proof of your ties to your home country with you to the Port of Entry (PoE)

A letter from your employer stating you are expected back on XX-XX-XXXX date

A rental agreement

Etc.

If the Customs & Border Patrol officer decides you don't have enough proof of your intent to return to your own country they can and will deny you entry. Hope this helps!

I did not have any problems at all.I just returned from visiting my fiancee in the US from the UK. At the POE I was asked who I was visiting and I told them and then the officer stamped my passport.

07/26/06- NOA1

07/07/06- IMBRA RFE sent from VSC

07/20/06- IMBRA RFE received at VSC

09/29/06- NOA2

10/17/06- received Packet 3 from London Embassy

10/25/06- Medical

10/27/06- Sent Packet 3

12/13/06- received Packet 4 from London Embassy Interview scheduled for 19th Jan 2007

12/14/06- Emailed embassy to Reschedule interview

01/08/06- received Packet 4 new interview date 26th Feb 2007

Also make sure that your fiancé does not bring anything that would make U.S. customs think she is going to stay.

e.g. don't have her bring a resumé (they may think she is job hunting in the US), and don't let her bring a lot of things over that may hint she is going to have a long stay.
