I have a question and I need your understanding about our situation. My fiance just filed my k1 visa and we're now waiting for NOA1 hard copy. We were talking about our future plans and he told me he's thinking of bringing my brother over after we're married. From what I've read you can only petition your siblings if you have the same mother or father but it is not possible for a USC to petition your brother-in-law. I'm just confused about this and I need your opinions. We discussed about this because we're planning to have a baby as soon as I get there and we're thinking of getting either my mom or my brother as baby sitter and he's planning to sponsor since he's the USC. This is just a plan and we're still asking around. I will appreciate any inputs. Thanks for reading.

It is not possible that he file for a visa for your brother or mother

but you could file for them after becoming a permanent resident

You can't sponsor a brother-in-law nor can you sponsor a brother while you are a permanent resident. My understanding is that your only option is to wait until you're a citizen (eligible 3 years after immigrating assuming you are still married) and then sponsor him. There is something like a 10 year wait for siblings, so your child will probably not need a babysitter anymore by the time your brother could come over. I don't know if parents are faster - someone will know, though. Either way, it will be several years from now. Good luck.

That's right you can only bring children or spouse to the US if you were permanent resident.

you can't. you have to be blood related. once you become a USC you can file for your mother or sibling.

you can't. you have to be blood related. once you become a USC you can file for your mother or sibling.

The OP is from the Philippians , where the wait for a sibling is a bit over 23 years and that would be after she gets to be a citizen which is at least 3 years away.
