Hi,

I filed for AOS, I-130, AP and EAD back in the beginning of August (Timeline below), I have received EAD and the AP in time without any RFE or any other problems. I am getting concerned about the fact that I still have not received my interview letter and there hasnt been any update on the I-130 or I-485 since August. I have called USCIS and spoke to the IO and they said that as of 2 weeks ago my interview was still not scheduled and the application was still at the NSC, not transferred to the Field Office. They said my case is in the normal timeline, which I dont agree with.

I have seen many cases already getting their letter, some who filed in Mid-September have received the interview letter. I am afraid that they may have tried to deliver and I didnt get it or got lost in the mail.

Is there anything I can do at my end?

You are still withing USCIS processing time which is 4 months. They could care less what is going on with other people as long as you haven't gone out of this time frame they won't do much. I think that the officer you talk to on the phone would know if you had an interview at least, call them everyday to check on your status and to see if an interview has come up. Then at least if something has gotten lost in the mail and they didn't update you on it you have reason to appeal.

I hope you get it soon.

You are still withing USCIS processing time which is 4 months. They could care less what is going on with other people as long as you haven't gone out of this time frame they won't do much. I think that the officer you talk to on the phone would know if you had an interview at least, call them everyday to check on your status and to see if an interview has come up. Then at least if something has gotten lost in the mail and they didn't update you on it you have reason to appeal.

Thanks, I was curious what the normal Processing Timeline was.

Its strange, the two different IOs have told me (1) You in queue to get the interview letter (2) Your case is still with the NBC. These two point contract each other, if I am waiting interview letter I would expect to be transferred to the field office and if its still at NBC, then I want to know why and they because of being within the Processing time, they wont say anything.

that sure must be frustrating for you not to know the exact status with different answers from USCIS and nothing online or in hand.

I thought I drop you a line here to wish you good luck and hope that you get your appointment really soon to be at ease (as much as it is possible but then you will most likely be nervous about the interview itself). I have no idea on the processes how applications are worked on and all we can do is be patient and wait. Discovered myself a few minutes ago in the October Filer Thread that a person who sent in their application almost a week later has received their NOA1s just a few days ago, following the next day the appointment for fingerprinting/photos arrived. I myself have received my NOA1s very quickly, before the other person I just mentioned but still am waiting for the appointment letter for biometrics - am I concerned? No, just puzzled as to in why, but also tell myself to just wait some more as I also read a timeline about this somewhere and for that I'm still within the normal procedure time.

10/17/2010 - USPS confirms delivery to USCIS

10/25/2010 - Check cashed

10/26/2010 - All applications been worked on aka touched

10/28/2010 - NOA1 Receipts for applications received

11/24/2010 - Received appointment for biometrics in the mail for 12/17 *yay*

12/17/2010 - 9.25 a.m. - 9.45 a.m. Biometrics done !!

12/23/2010 - EAD Approved and Card on its way - Email notification received *yay*

01/03/2011 - WOOOHOOO ...EAD Card in Hand!

01/04/2011 - Oh boy....Received Interview Letter today - February 3rd is the day! :)

02/03/2011 - Interview scheduled 12:45 p.m. - out of there before 1:30 p.m. - further review

Coming home, checking for touches at 5:30 p.m. - CARD PRODUCTION ORDERED !!!!

02/10/2011 - E-mail notification "Approval letter was sent today"

02/14/2011 - Welcome Letter / Approval NOA and Card (separate envelope) received!!! :D

Late November 2012 (have to look up my receipts ;) - mailed in ROC I-751

12/12/2012 - NOA 1, status extension received

12/18/2012 - Biometrics appointment letter received

01/08/2013 - Biometrics done

You need to be patient. Your interview is scheduled when your local office has openings in their schedules. If the IO told you it hasn't been scheduled yet, then they are right. You are probably "in queue" and waiting at NBC until your appt date is set and the file will be sent over. Those statements do not contradict eachother. Other people that got it faster were at slower volume offices. DON'T call them every day. There is nothing they can do to make it go faster. NYC is a bit busier than other offices, but there are plenty worse. Look at our timeline. If you called and they said your appointment date has not been set, why are you concerned the mail was lost??
