Just out of curiosity, why would a marriage visa (as opposed to fiance visa) go to a different embassy for the interview? I thought they all went to the same places--for example, my husband would have gone to London no matter what we had applied for. Is this not the case in other places?

It depends on the country and how many Consulates they have that are processing family based visas. Canada has two consulates that process. One processes all visas and the other one only processes K-1. They are on different sides of the country.

Colton, you can file the I-129F for a K-3 visa, which is the marriage-based version of the fiance visa. You should not have to pay the $455 fee. Take a look at the info for the form on the uscis website: I 129F form.

Someone told me recently that the K-3 no longer exists. It is marriage based only with the I-130 form.

I'm pretty sure that the K-3 visa is pretty much done away with now..

As far as I know, the only real doable option is the CR-1

Also, Colt never suggested LYING to USCIS. I think they are just confused about the classifications for each visa, as I-129f used to be applicable for K-1 and K-3. They would have been eligible for K-3, which I believe is no longer being processed. Someone told me recently that it is now CR-1/IR-1 only with the I130. Could someone clarify this?

Colt, I-130 is unfortunately your ONLY option. This site has a lot of information which can aid you in getting through the interview (and the city) safely. I would recommend being in attendance for your wife's trip, or having someone who is familiar with the city attend with her. In this case, fear is good and it will allow you to plan for the best course of action. Check out the regional forums and you will find some people who have gone through the same process who can advise you on the dangers and how to work around them.

This is the purpose for the I-129F visa as stated on the USCIS website: To petition to bring your fiancé(e) (K-1) and that person's children to the U.S. for marriage to you or to bring your spouse and that person's children (K-3 and K-4 visas, respectively) to the United States to complete processing for permanent resident status (under the LIFE Act and Amendments of 2000).

If they were no longer processing these visas, then I would think it would not be stated on the form. There was another person who responded to this thread who gave the impression that they are going the K3 route, so I would be under the impression that it's still being processed.

Thank you all so much for the replies! I do want to clarify to anyone who thought I meant anything dishonesty, that I never meant to make it sound like I wanted to hide anything at all from USCIS or anybody. Please don't mistake my ignorance on these subjects with any bad intentions on my part. I would never be dishonest especially with something like this. Also, I realize that it is called a Fiance visa so it doesn't work when we are married, I was only asking if the marriage would be recognized or legal here and if it wasn't then perhaps I would be able to file the fiance visa because we legally wouldn't be married in that case. Maybe it sounds like a dumb question but I don't mind asking them with something like this, I just want to cover all my bases. Once again, I would never lie or do anything even remotely illegal like fraud...I'm just trying to learn about these things to avoid accidentally breaking any rules. Thank you all so much for your time and help.

Nope, sorry, the K-3 IS DEAD.

Once they 130 and 129f both get approved, they will close the 129f at NVC and proceed with the 130 for Cr-1 visa.

If you actually looked at the K-3 forum, it is mostly people saying the K-3 is dead. I'm not sure why they haven't deleted that forum yet, but this change only happened in Feb of this year. There is no longer a need for the K-3 as the CR-1 is going just as fast now. You can still apply for the K-3, but you won't be able to obtain it. There is a bit of "turf war" going on it seems between USCIS and NVC or something, which is why it looks available but it isn't.

K3 is officially on the books, but nonexistent in practice. USCIS ties the I-130 and I-129F together and sends both to the NVC at the same time. NVC then closes the I-129F leaving only the I-130 for CR-1 active.

Debate about visas in this case ia academic. The OP is married. He is pursueing a spousal visa. At this time, no other visa could have any possible advantage and none of them avoid going to Juarez. There is no possible advantage to the OP of changing visas. I do not suggest anyone lie and especially when it cannot possibly have any beneficial affect.

Proceed with the visa you chose.

Isn't it funny how we worry for our beloveds? I just found that my wife and three children have to travel from Cape Town, South Africa to Johannesburg for the interview, and though not nearly as dangerous as what you're speaking of, it still worries me. Calm your fears, have faith.

I agree with the counsel above, please do not even consider doing anything "technical" whatsoever! Follow the procedure the way it is layed out. Anything else could only raise unnecessary flags that you don't need right now. And being in any way "misleading" it's not a good start to your forever together... it opens the possibility of employing the "technical" excuse in other areas of your life, including your marriage. NOT GOOD!!! Every day apart seems like one day too many, and every fear is exagerated by distance, but hang in there, you can do it. It helps to know that EVERY person coming to America (legally) from Mexico has to meet the same conditions and requirements as your wife, and hundreds of people do every year. I also agree that if you can travel to be with her when she goes, make a holiday of it. Our long-distance relationships have endured tests that most others will never know. It exercises our hearts in ways that many never experience, and our love only benefits from it. I know that my relationship with my wife is stronger and more intimate (not just sexual) than most people we know, and we know MANY!!!

Hi here is a link to a forum with lots of Cd. Juarez info! we are going thru Juarez K1 visa with Mom & 2 children in March/Aril...it is scary but honestly the Gov't does not seem to realise or care that so many people need to travel to this city for services at the consulate. I like many others wish it could be changed to Cancun or someplace nice where you could enjoy your stay, do the visa interview, then find a plane to where ever into the USA. Yucatan is wonderful and much safer!

Anyway, don't worry to much...look at it as bragging rights later on!

As for the fiancee/spouse visa you have no choice now that you are married...hang in there! best wishes!
