Hi everyone. I filed my AOS last month, got my NOA. However, I didn't file for Advanced Parole because we really didn't had any plans traveling anytime soon so I figure i'll just wait for everything to be completed. Sudden change of plans though.. my question is can i still file for AP even though my AOS is now pending? Helpful response is truly appreciated.

Thank you in advance.

If you are a K3 visa holder, you are free to travel and re-enter for two years on your K3 visa. You wouldn't need AP until July 2011 and should have your GC by then.

Just send it in along with a copy of the AOS NOA1 as proof that you don't need to also send in a fee.

You don't need to file for AP, you are a K3 visa holder; K3 visas are multiple entry visas. When you travel, show the POE officers your AOS NOA1 as proof that you have an AOS pending. How long are you planning to be out of the US?
