sponsor is aunt of fiance/pregnancy

Hi. We filed for a K-1 visa last Sept. 5 2010. My fiance(e) currently lives in VA and is a US citizen (by birth). Will we have any problems later if my sponsor isn't him but his aunt? We're still trying to save money to raise a family since I am 23 weeks pregnant. He got his old job back in the states. Also I reviewed most K-1 cases and average for interview is after like 5-6 months. My expected due date is on March 5. What can we expect? What will we do if our baby is born here (Philippines). Do we add more documents for our visa application or do a consular report in the US? Thanks very much!

1. The fiance(e) has to be the sponsor on a fiance(e) visa.

2. The aunt can be a co-sponsor for support, but I recall reading somewhere here on VJ the the Manila Embassy frowns on co-sponsors for K-1 visa's.

3. You fiance(e) should file an Application for Consular Report of Birth Abroad once you give birth and receive the birth certificate from the NSO. He'll need to provided proof that you were together during the time of conception and possibly provide other proof that he is the biological father. You need the CRBA for you child to get his/her US citizenship and passport. You'll also want to get him/her a Philippine passport.

11/15/10: I-130 package FEDEX'd to Chicago Lockbox

11/15/10: NSO Marriage and Birth Certificates available for pick-up at NSO

11/17/10: Receipt Date of I-130 petition at Chicago Lockbox

11/19/10: NSO Marriage Cert and Birth Cert (4x each) received by Gina in Philippines

11/19/10: CRBA package couriered to US Embassy in Manila

11/22/10: CRBA package/application including NSO BC & MC received by embassy

11/22/10: NOA1 Date

11/24/10: Electronic notification of receipt received from Chicago Lockbox

11/24/10: Embassy scheduled CRBA appointment for 12/21/2010

11/26/20: Check cashed

11/27/10: NOA1 Hardcopy received via USPS

12/21/10: Interview/Personal appearance at Manila Embassy for CRBA **approved**

01/03/11: CRBA and US Passport for daughter received by Gina via FEDEX

We're also using a cosponsor. But I think Ireland is a fairly easy consulate so we should be ok, hopefully you will be too. It would be so unfair if they didnt accept a co sponsor. good luck.

October 8th- Sent off K-1 visa package

October 21st- Received email saying we have been assigned to CSC

October 28th- Waiting on NOA1

October 29th- NOA1 received!!!

March 16th 2011- Received email saying petition for fiance has been approved and that NOA2 is in the mail!

April 12th 2011- Waiting on lettter with interview date from Dublin Embassy. Medical scheduled for 26th April

Hopefully, your fiance's current job pays enough to qualify as it is rare for Manila to accept a cosponsor in a fiancee visa case. Current income is the key.

Hopefully, your fiance's current job pays enough to qualify as it is rare for Manila to accept a cosponsor in a fiancee visa case. Current income is the key.

So I just spoke with Anton (my fiance) and he said he submitted documents regarding his income and that he would also sponsor me together with the one from his aunt as a co sponsor. He said his job pays enough and not to worry.

:ot: Sometimes his confidence makes me think he just doesn't want me to worry too much and to concentrate on my pregnancy instead. Well, I do hope and pray that his income IS enough and that we won't have any problems when dealing with manila consulate later on.

Oh my God. YES. That is plenty... For a household of 3 you are only required to make a yearly income of $22,888. He is currently making $39,561.60 a year. So now... please stop worrying and focus on your healthy baby! Good luck and congratulations on your child!

P.S. No co-sponsor needed!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Oh that's good to hear. He said they just subtract around 150 a week for tax. I hope there's nothing else to worry about..

This is such a relief. He's the one so busy with work and trying to provide money for us and I focus on the visa and working on being together. But it is so stressful at times, esp I get paranoid something might go wrong. I hope not.

Yes he doesn't have any other children, just mine!

in the case of the baby... i gave birth to our daughter on june 25th 2010, we had to wait 3 months to recieve her jamaican birth certificate, after we got it, he made an appointment with the us embassy in kingston, he flew to jamaica a day efore the interview and we took her in, they did'nt ask 4 any blood test r anything he just presented his proof of his citizenship (born in the us) her local birth paper, he register her as birth abroad, they asked us a few questions and asked y we took so long to register her at the embassy (3 months), we told her we were waiting 4 the birth certificate, she then let us raise our right hand and swear, then i picked up my daughter's us passport and birth abroad certificate 7 days time. i suggest u do the same.

That's enough.

The fiance is ALWAYS the sponsor. The fiance can use a co-sponsor at most, but not all, consulates. Seems like you will be fine.
