time of relationship?

i have known liu since end of july 2010. i feel as if i have known her forever:-)we chat daily for 2 hours in yahoo cam. i speak with her 13 yo daughter the same way.i am going back for 12 days in early january 2011. we plan to file [K1] in early february.we have all of the chats and emails.is it an automatic denial becsause only 6 plus months?i am 57 and chose to not marry, as i never met the "one". now i have:-)it is very hard to be apart from her.

waht are the average time frames for successful 129f and 325a filings?

is it an advantage for us that i am 57 and she 45?

is it a plus for us i want to have her 13 yo daughter[yuxian] here with us?

i'd say your age is totally fine. it qould only be an issue if you were 57 and she was 20. there's not really a time limit on relationships. and by february 2011 you'll have known her close to a year. have ye visited each other? that would be good for providing proof of relationship for the 1-129f and your interview. I know we're all expecting to wait between 5 and 9 months for our visa's to come through. hopefully no longer!! i'm not sure if the daughter is a plus eactly but i'm sure it's not a negative either. but it's defintely not automatic denial if you're only together 6 months. whats important is getting al your proof of relationship ready like phone bills, engagement ring receipts, photos, travel itinerarys and passport stamps. good luck!

October 8th- Sent off K-1 visa package

October 21st- Received email saying we have been assigned to CSC

October 28th- Waiting on NOA1

October 29th- NOA1 received!!!

March 16th 2011- Received email saying petition for fiance has been approved and that NOA2 is in the mail!

April 12th 2011- Waiting on lettter with interview date from Dublin Embassy. Medical scheduled for 26th April

As in the above reply, by the time you file you will have been in the relationship for about a year. I started getting close to my fiancee and things turned romantic around Aug/Sep 2008 and I flew over for a week that December to meet her for the first time. I actually filed for the I129F petition for the K1 visa in October 2009. So in my case I had known here a little over a year. In the mean time she had visited me twice in America for 2 weeks and then a month. We submitted photo's from my visit to England and her visit to the US, copies of airline boarding passes, passports with entry stamps, itineraries, a narrative of events, a list of emails (although we mostly communicated via other messaging or ventrilo). I had my brother-in-law review it for mistakes; he is an imigration lawyer (work visa's), however he didn't review it as a lawyer, but rather just to proof read it and check that all the information on the forms looked good.

In our case it was about 9 months from the application being sent in until the embassy interview and medical. I think most people get their interview in about 6 to 8 months depending on embassy and how loaded they are. Your ages are fine and the fact that your intended has a child is of no consequence as long as you can show financial ability to sponser fiancee + child. The more people there are, the higher the financial expecations although its not a high bar (poverty guidelines). The country you are sponsering a fiancee from may have some bearing on the length of time and the degree of scrutiny due to the levels of sham or fraud issues typically associated.

- 2010 Nov 2 Courier website shows K1 Visa packet enroute for delivery. 1st indication of final approval!

- 2010 Nov 3 K1 Visa packet delivered by courier! Visa's are in the building and in my fiancees hands! (tentative Jan 2011 arrival)

Guangzhou is a tough consulate, and tough consulates do tend to scrutinize short relationships more. While it's true that the relationship will be roughly a year old by the time the interview is scheduled, they may still look at factors like how old was the relationship when the petition was filed, how many trips has the petitioner made to visit the beneficiary, etc. The whole list of what a consulate considers to be fraud indicators varies between different consulates, but some factors are common. Six months between the online introduction and the first face-to-face meeting won't be a problem. Filing immediately after the first face-to-face meeting might look like you were rushing the immigration process by filing as soon as you were eligible, rather than letting the relationship evolve. It would be a problem in Southeast Asia, and I imagine it could also be a problem in Guangzhou.

For the average times, click on the "Immigration Timelines" link in the menu bar at the top the page, and then look at the links under "Statistics".

Your age difference is not an advantage, but it should also not be a significant disadvantage. 12 years is not a huge gap for a middle aged woman.

Bringing her daughter is not an advantage, and may be a slight disadvantage. They tend not to suspect older beneficiaries of being primarily motivated by a desire to start a career in the US, but when there derivative children involved they may suspect the beneficiary is motivated by a similar desire for their children. Whether or not you want to bring her daughter is not really relevant. Her daughter is eligible for a K2 if her mom gets a K1. The only thing she needs from you is an affidavit of support. Now, if you didn't want to bring her daughter, that might be a big red flag.

Anyway, this "bona fide relationship" stuff can be very consulate specific. I recommend you spend some time in the regional forum for China.

For sure Guangzhou is not an easy Visa Embassy to deal with. A couple of small so-so answers was enough for my girl to get a denial. We talked for 11 months before my visit, engagement dinner, and applied K1 following month. Recently K1s go from 5 to 8 months. Your fiancee needs to know and understand, every piece of evidence you send in better than the interview officer, and how to RESPOND to each question asked. Having the correct answer is not always just enough. Good Luck...
