Timeline

I have no intention of lying on our ds-230. With that being said I am still extremely scared about what our outcome might be. It says not to send them police certificates from the U.S. fine. It asks if there were any prior arrests...yes. He was arrest on assault charges and never tried because he left the country in the midst of it all. The person who he was arrested with (who was the MAIN offender) however had the charges dropped to a misdemeanor. I also mentioned that he was a meth user years ago in my affidavit of our relationship (which I had to because they asked about his sudden weight and appearance changes)

Fine. So I have my drug use, arrests, and overstayed boxes checked....and I can't help it but be discouraged. Has anyone been through a case like this and still made it to the U.S? Overstay equals an I-601 waiver....but what about his pending trial and admitting to a past drug addiction?

I feel lost and confused. (I am waiting for a call from a lawyer but personal experiences are greatly valued)

I need all the help I can get. We are just good people in a bad situation.

There is no waiver for past drug addiction.

They may ban him for 12 months if they believe he has recently used drugs.

It was previously a 3 year ban, but I understand they have now lowered it to 12 months.

I have no experience with the trial for assault, but I do hope you have the means to hire a lawyer.
