Does anybody recall when did the CBP (customs border partrol) start using I-94 for entering the US as a non-immigrant visa and Does this includes Canadian Citizen visitng the US as canadian does not require a Visa to enter US? Because in Part II of the I-94 there is also a question regarding arrest charge similar to Question 41 on DS230 Part II. So if you have answered No on your previous visits to US in form I-94. previous visit like years and years ago and then you answered YES on DS230 question 41.. it can trigger a mis representation and can cause you to file I-601 in your visa interview. So anybody knows when did they start using I-94 it looks to me that this is just recent or maybe a few years back?

I-94s are entry/exit visas and they have been using them as long as i can remember for non-Canadians. Those coming from a Visa waiver country actually get an I-94W - and that dates back to when the Visa Waiver programme started.

Canadians do not get an I-94 if they cross into the US to visit without using an actual paper visa (K-1; B-2, TN, etc.). It is acceptable to answer "Canadian visitor - no I-94 issued" where it asks about an I-94. As a Canadian you would not have received an I-94 under the normal course of affairs. If you had been told by the border official that you could not enter without an official visa and you got that visa, then you would have been issued an I-94. If you had entered and the border authority limited the length of time he was allowing you to be in the US, he would almost definitely have issued you an I-94 with the validity date recorded.

So, in all likelihood, you have never received an I-94 and so will never have had to answer that question on the form.
