seems correct to me. Nice...so while others are getting approved in 3 months, we are going to get approved at around 7-8 months. This all was to speed up processing correct?  We all deserve expedites at NVC for the ###### we have gone through.

Yes, to speed up, exactly. That's why the cases have not been entered into the system until November 23rd

Well, just got off the phone with USCIS, after following the instructions given to me by a Tier 2 rep last week.

Here is the newest information I received from my Tier 2 rep as of tonight..

1. The service request is still being processed.

2. Our case was given a priority date at TSC of Nov.1, but the information was not formally entered into the system until November 23. This being the case, TSC has 90 days in which to work the information as given, so based on the information, I was told approx. that the case would be adjudicated in or around Feb. 23.

3. Apparently a lot of cases were entered into the system at TSC by November 23. And most of them are now being worked. No other information was available in the system at this time.

I also found out that when you call the Customer Service Line, you could be talking to a CSR anywhere in 45 field offices in the US. Most Tier 2 are located in Los Angeles. They also only identify themselves by there last name and there ID number.

When I asked about the processing dates that TSC were working on, the Tier 2 rep explained that there was no definite date they were working on there at this time. They were working on the cases as entered into the system. This was information to me, and I wanted to share it with all of you.

So, that is the just of my conversation with the Tier 2 rep. My Tier 2 rep also advised that if you are feeling left out, contact your US Senator, or your US Congessperson as soon as possible, to assist you in the process.

That's it everyone, sorry I don't have more for ya.

Thomas

Thanks a lot for this, Thomas. So Feb 23, eh? I think I can deal with that, IF it really turns out that way. Geez louise...

I try not to go on the main forum page so I won't have to see those approvals. This is the situation we're in and seeing that kinda stuff doesn't help- at least that's how I feel.

The last person told me to wait 180 days from my last notice. Another 6 months!! What a joke!! I'm already at month 6 and counting.

I don't post much but I am in with ya all...I called the customer service number and was told I had to wait 60 days from the last action that was taken on my case (which was 11-30-10) before I could submit a service request...

Thanks a lot for this, Thomas. So Feb 23, eh? I think I can deal with that, IF it really turns out that way. Geez louise...

Today is 5 months + 1 day from my NOA1 priority date. I will do whatever it takes to file a service request. I found a USCIS "Customer Guide" guide online that states that WE CAN file a SR if the USCIS processing time is outside of their guidelines (http://www.uscis.gov/files/article/F1eng.pdf - pg 1, lower left, paragraph titled "Processing Times"). Also the USCIS processing times FOR ALL service centers for a spousal I-130 is 5 months (https://egov.uscis.gov/cris/processTimesDisplayInit.do). I don't care how they manage service centers internally. Our NOA1 date was Aug 5, it is past the 5 months and their own documentation states I am entitled to service request.

Obviously, I will be super polite and politically correct when making the call and will start with the “assumption” that the rep is good at his or her job and wants to help me (hmph, hmph – clearing my throat). If that doesn’t work, I will continue to be super polite and respectful and point out that their own documentation states that they will process a request if they are outside of the posted processing time frames. If I feel I am getting nowhere, I will simply say goodbye, call back, get another person and try again.

If your NOA1 date is older than 5 months, I strongly suggest you do the same if you haven’t already. If their response to my request for an SR or their response to the SR itself does not meet “normal expectations” under THEIR guidelines, I will also contact my congress people and an Ombudsman. In the meantime, if they tell me to call back in 60 days, 180 days, or any other unacceptable time frame, I will simply keep calling back until I get a rep that can help me.

Another avenue I might try is to make an infopass appointment at my local USCIS office. I have done this before and they were actually very nice and helpful. Since I wasn't outside of the processing timeline, they couldn't do a lot for me but, since that has changed, I will go their again if needed.

I am sure all of us are feeling the same way, after seeing this justice from USCIS, on one side people who have crossed their timeline, , and still unaware when and how this waiting game will end and on the other side people are having their approvals in less than 100 days, I will never forget this time,

My 5 months will be up very shortly (NOA Aug. 9)- I agree with your plan of action.

About calling back if one officer is not helpful- I will share this. I was getting absolutely nowhere with a Tier 2 Officer (see my prior conversation on this thread)- so I tried calling back and lo and behold, just my luck, my call was escalated to the same officer. I mean come on- really?!?! What were the odds?!?! :bonk:

Making an infopass appointment had also occurred to me- unfortunately my job doesn't allow for time off during a weekday, and I can't imagine them being open on a weekend. :( If you or anyone knows for sure that an infopass appointment has gotten results, then I'll seriously have to think of requesting time off of work.

USCIS - 203 days

08/09/2010: NOA1 (I-130) Received text & email with case number

02/28/2011: Received NOA2 hard copies of approval for I130 and I129F

03/02/2011: NVC Case Number Assigned, received IIN #

06/06/2011: AOS and IV received at NVC

08/24/2011: Embassy Interview

09/14/2011: Visa granted

I know it seems like a long process, but I still have a Service Request pending, because the case is outside of the processing times. Our date was July 9, so we're almost a month over the line. As soon as I get any information on the Service request, I will be sharing it with everyone and what the contents of the letter says to me. After all this time, I'm just hoping that I don't get a RFE.. that would probably just kill me.

Now I would utilize a Infopass appointment, your Congressperson, your Senator, the Ombudsman, and anyone else that will listen after your processing date. I'm not saying that everything I have been told is golden, because we all know how this process works. I'm just passing on the experiences that I have had with my 2 calls to USCIS so far, and I will continue to share what I am told as I call and speak with these folks that are holding all of our families hostage.

I have gone back to see my wife for a period of 3 weeks, because I couldn't stand to be apart from her, and during that time, as I have previously said, we became parents to be, so I've already missed the first 2 months of our pregnancy. I'm as angry as a hornet right now because I can't be with my wife during this time. So, yes I'm angry, there are many things that I'm not being allowed to share with my wife because of this hold up. But I'm trying to maintain to some extent. So, my friends, as with you, my frustration is up, my anger is up, and my contempt for the entire system is there. But, even as I say this, I can only hold to the point that perhaps the information I receive is the truth, or at least a partial truth. It gives me a glimmer of hope that I won't miss a lot of the pregnancy.

So, I know your all frustrated, and we have all gotten the big blue one, without a kiss, but I'm just tryin to help and support those that I can with the information that I can gleam with my chats with the Tier 2 reps, that are willing to share. And to pass those chats on to everyone, so we might still have a little bit of hope that we will be with the ones we love very soon.

Thomas

Just received two pieces of mail regarding my case. One is a response to my service request made on 12/27. Looks like it was sent from TSC and says what the other people's letters have said. Nothing new there.

Other letter is from my congressman. He wrote, "In an effort to try and be of some assistance to you, I have written to the Texas Service Center on your behalf. Just as soon as I hear any further word from the Texas Service Center concerning the I130 petition you filed on behalf of your husband, I will be in touch with you immediately."

We'll see where this goes.

Hello ALL

Spoke to my Attorney today, said my 5 month was up yesterday

and i should be getting approved this month. He called TSC

amnd spoke with a higher level person who just said they CSC

was so backed up, they had to send the us to TSC.

They are so backed up he said they are runnng at about 6 months

instead of 5 months now.

He said Expedites wont work they are only processing them for

life and for serious situation with Senator and doctor request

only. So it looks like by the end of Jan i look to be approved.

Good Luck
