I am soooooo sad for you and I am happy for you at the same time. I am sad that it was approved so long ago and that you have lost all of this time. I am happy that you got an answer and it looks like your process is back on track and will end in being together soon.

I am curious...After the switch to TSC, were you one of the people who had the status change notice that your petition was further transferred to a "USCIS Office"?

When my petition was transferred from CSC to TSC, I then received an email stating that my case had been transferred to a USCIS office for processing. When I received my NOA2, it came from TSC. Looks like it never left TSC. Just hanging on til the first of the year. I will give it some more time........don't know how much longer I can wait before I blow my top!! Wouldn't be the "smart" thing to do though. Anyway, God Bless Us ALL. May we all have a VERY Happy New Year as we are re-united with our families.

Would it be a bad idea to now file for the k-3? This waiting period is ridiculous and is really pissing me off! I have two small children who need their father. What happened to family unity? This whole process is so unfair. They should make it so that spouses of American citizens can get to the U.S A LOT quicker.

AGREED!! My two USC daughters are still with their Mother (my wife) in the Philippines, and they don't understand WHY their mother can't come NOW!! My older daughter is exhibiting signs of depression coupled with disobedience to her Mother. (She is 12.......13 on Feb 14). I try to console them via Skype every day, and let them know we will all be together soon. My wife keeps telling me to be patient, but that has never been a virtue of mine.

just called USCIS and they would not put in a service request for me. They said I have to wait 61 days until the day of transfer (january 3rd), did any of you get that information when you called? Such bs....I asked about why people are getting approved in September and they said the same ####### about some cases taking longer. Im pretty pissed off right now.

...got the same situation too...USCIS told me to wait till January 6 and if i wont hear anything from them by then..this means war....lol!

Lets keep our hopes up even though its really draining now...

Celldoc: My background is in Electronic Engineering Technology (for Honeywell and John Fluke Instrumentation). I am an analytical type person and most call me a perfectionist. No, I don't have any formal training in law (it makes me sick to my stomach when I see what is going on in the courts in this country). But I have had several friends who are lawyers and I like to keep track of what is going on especially in the legislative branch of our government. I filed the I-130 (NOA1 is August 6) and then filed the K3 (NOA1 is August 30). I think that my appeal in January to my Senator and/or representative will be more along legal lines of what they (the USCIS) have done and are doing. We will see what happens.

It would be interesting if we could find someone in the media to take up our cause. Does anyone have an inside track on anyone in the media that would be interested?

After Congress sends a Bill to the President, and He signs the Bill into law; that's where the problems begin. The BUREAUCRATS take over. They implement the laws according to how THEY interpret them. Bill, I think you are on the right track. USCIS and NVC are stacked with career bureaucrats. Administrations come and go while their jobs are secure from year to year. Talk to you attorney friends. Perhaps a law suit filed (class action??) against DHS (USCIS) and/or DOS (NVC) would at least get someone's attention. Just a thought..... Also, I believe national media attention is key in exposing the incompetence of USCIS/NVC. We have members right here on VJ that represent all 50 States. As for me, no matter what happens to my case, I will never forget the insensitivity and bureaucratic bungling of our collective cases by USCIS and NVC.

We need to do a lot of research on the Law that created the K3 non-immigrant visa. As far as I know the Legal Immigration Family Equity (LIFE) act that was signed into law by President Clinton on 21 December 2000 has not been repealed. I could be wrong though.

Back?? I've been here all along! And I've been trying to stay as optimistic as possible- you guys have been a source of support in a weird way without even trying. :D

Hahaha!! Maybe just got too excited after all the venting..Been monitoring this thread diligently, hoping for any one of us bear the good news..As it is, even without the NOA2 yet, it helps me survive day in and day out..

I can assure you that you are not wrong. The USCIS would fall all over themselves to take that heading (K3) off of their web sight if had been repealed.

Happy New Year to those who have already passed midnight and for those who are about to... may much joy be brought in 2011

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

It has been 15 business days since our 130 was approved (Dec 9). Still no NVC case number. NVC says they do not have our file. I emailed TSC Dec 24 asking for the exact date that our 130 was sent to NVC. No response yet.

Dan - Given TSC said they never sent your file to NVC, I am pretty confident they did not send mine either. I will call NCSC Monday and demand an answer on the location of the file and why it has not been sent to NVC. Total waste of a month. What do they care?

I am completely on board with filing a class action lawsuit against USCIS. Let's seriously look into this and post about what we find.

I can only imagine how you and DanTes feel. I'm not sure whether I prefer to be in our position - expedited, but waiting impatiently for action, or apparently approved but still no further forward.

Does anyone know if ANY ONE, has been moved onto NVC and onwards from TSC? It seems to me TSC are on complete lockdown, and despite posturing, have actually achieved nothing whatsoever since all of us were transferred.

If anyone has any success stories from TSC, please let us know.

So you're a "perfectionist". Not to be disrespectful, but what does that mean?? That term is relative, and frankly speaking, just tells me you're another educated brick in the wall, like myself, without a background in law- again, like myself. It's nice that you have friends with law degrees- so do I (from places such as Harvard, Yale and Northwestern). The pertinent question is however, do any of them practice Immigration Law? For example, I have a friend in Boston who was a Rhodes Scholar, went to Harvard Law School, and now works for the Environmental Protection Agency. Can he help us in our cause? Absolutely not, and clearly not because he is not educated enough, but simply because neither is he up-to-date with the immigration arena, nor does he have contacts who can pick up the phone and call a higher-up at the USCIS.

My 5-month mark is approaching, and like you and the rest of the gang here I too have been given conflicting information regarding not just my case but also the goings-on at the USCIS/TSC.

In my opinion, our primary goal should first and foremost be obtaining an education from a reputed immigration attorney. It clearly will not suffice to merely have brief conversations with friends who are lawyers. And when I say "immigration attorney", I mean one who has solely been specializing in this arena for some time (which would presumably mean he/she would have political connections that would be able to actively help).

As for media attention, I personally think it's wishful thinking to think that some media giant is going to run with this story on any meaningful national scale. With that being said however, even one or a few local articles regarding this issue may help give it some sort of political legitimacy and draw the attention of a government official or a prominent attorney. Who knows.

As I had posted before, I'll try my best to continue researching our issue. In the meanwhile, for those of us who continue to contact the USCIS/TSC, I think it's important to document the date, time and content of our conversations. The more thorough collective data we have at our disposal on VJ, the greater our chances of efficiently continuing to chart inconsistencies and formulate a less murky picture of what may actually be going on.

Just my 2 cents.

I wish upon all of us a happy, fruitful, and healthy new year, and pray for speedy reunions with our loved ones.
