We are sending you an update and a follow-up regarding your case.

Your application was ordered approved in November, however, the processing is not complete. The application has not been transferred to the National Visa Center, and the approval letter has not been sent. A request has been made to the adjudicating officer to complete the processing of this application.

If you have any further questions, please call the National Customer Service Center at 1-800-375-5283.

Sorry to hear that but yet another proof of their ineffectiveness and lack of care for the customers.

I don't have a clue!!! Looks like it was approved, BUT still needs some more "processing" before they forward it to NVC. I think those simple servants at USCIS need to be processed OUT OF GOVT. SERVICE!!

DanTes - I've just dropped in for the first time in a while. This turn of events is quite shocking. I can't imagine how it feels and am sorry this has happened to you. It makes me wonder what on earth is going on with our files. I wish it didn't sound so trite but I truly wish you the very best in getting out of this morass and getting to the life you dream of with your wife. Needless to say, I wish the same for all of us who feel like we are in limbo right now.

Well Dan as you know I am waiting just as you are. Sounds to me as if the person doing our case is either on vacation or worst yet, just inept at working on I130 cases, remember texas hasn't been processing these types of cases and simply don't know what their doing or how to do it. Well here's to waiting another week Tom

I am soooooo sad for you and I am happy for you at the same time. I am sad that it was approved so long ago and that you have lost all of this time. I am happy that you got an answer and it looks like your process is back on track and will end in being together soon.

I am curious...After the switch to TSC, were you one of the people who had the status change notice that your petition was further transferred to a "USCIS Office"?

I second what you're saying, although I can't say I agree with the "illegally circumventing the law" thing, at least not without proper legal documentation.

The K3 visa was put into law by the US Congress. It was meant to bring spouses of US Citizens to the USA while waiting for the I-130 immigration approval. The K3 law has not been retracted. The only thing that has changed is that the USCIS has made a rule change in that if the K3 visa approval and the I-130 immigration approval are approved at the same time (ie, show up at the NVC at the same time) then the NVC administratively closes the K3 visa petition (which they well should).

But they (USCIS) should not attach the K3 visa petitions to the I-130 petitions. We generally file the K3 1 to 3 weeks after getting the receipt for the I-130 petition and then wait 5 months for the I-130 approval. The USCIS and NVC should process the K3 in approximately the same time as a tourist visa. They are circumventing the law if they do not - they attach the K3 to the I-130. They are the ones that are making the K3 non-viable. They have made it non-viable on purpose. So again they are "illegally circumventing the law".

Would it be a bad idea to now file for the k-3? This waiting period is ridiculous and is really pissing me off! I have two small children who need their father. What happened to family unity? This whole process is so unfair. They should make it so that spouses of American citizens can get to the U.S A LOT quicker.
