I am one of the four I-130 (IR-1) Petitioners that was approved by TSC after being transferred from CSC. My NOA2 date is 23 November. The problem I now face is that I have not yet received my NVC case #. To my knowledge neither have the other 3 petitioners. I called NCSC this morning, and the representative told me that my case had indeed been approved, and that it was forwarded to NVC. I then talked to a representative at NVC, and was told that since I had not yet received my case # by now, that I could expect at least a 90 day additional wait. Wednesday will be 15 business days since my petition was approved. I will send NVC an email with a copy of my NOA2 attached on Wednesday if I still do not have a case #. I don't think it will do any good though. I am now convinced that the transfer from CSC to TSC HOSED ALL OF US!!!!

Looks to me like TSC just stopped working on I-130s regardless of their status, so approved petetions just collecting dust at Texas the same way others which needs adjucation. I think we all who got 4 touches at TSC are ready for adjuducation, thing is some body needs to do it. Unbelievable,,, service centers are actually not helping each other, in the fact they are fighting... TSC might have issues with CSC regarding this transfer and extra work considering the fact that CSC is now working september and they might not so backlogged as seen at that time. While having same ammount of manpower, TSC work schedule of their regular job of employment based visas might get disturbed because of this massive transfer, and offcourse who in government cares about the public and want to work with 100 % efficiency. Just a thought......

At this point I would be happy to drive to Texas, pick up my approved petition, and hand-deliver it to New Hampshire. While it may be true that none of us have a "Constitutional Right" to bring our foreign-born spouses to the U.S., the 6th Amendment gives even accused criminals the right to a SPEEDY TRIAL. Also, what about those unalienable rights espoused by the Declaration of Independence - Life, Liberty, and the Pursuit of Happiness?? DanTes: They are running over a higher law than the US Constitution. Namely the bible, "What God hath joined together let not man put assunder". I was just thinking: Congress passed the legislation for the K3 visa so that spouses could come to be with their husband/wife while waiting for the I-130 approval. Seems to me that the powerful USCIS has circumvented that legislation. Shameful. They should be able to handle the K3 same as a tourist visa that takes no more than 2 weeks.

3 more weeks and I have waited the 5 months and then my Senators and Congressmen will hear from me. Thanks to all here on VJ for the good work on our problem!

:thumbs:AviatorBill, I agree with you 100%. The problem with the Bureaucrats is that no matter how inefficiently they perform their jobs, for the most part they cannot be fired. They just get promoted to a higher position within the agency depending on their seniority. Representatives and Senators come and go depending on the will of the people, but bureaucrats implement the laws passed by Congress, and signed by the President, pretty much as they see fit. The law basically states that the "goal" is to REUNITE FAMILIES!! Secretaries Napolitano and Clinton will be history in 2 more years (if not sooner), but the bureaucrats remain. Immigration reform has been placed on a back burner for the time being, and it is just our bad luck that a lot of us are caught up in the vacuum created by Congress. I certainly feel for the Haitians (and others), for all they have endured to this date, and I do not begrudge them the priority they are currently receiving (maybe a little bit). IF "charity begins at home" - I want to be reunited with my wife NOW!!! I am sure I will be slammed by these insensitive remarks, but it frustrates me that when I call NVC I have to press 2 to get into the system!!! Shouldn't I be pressing 1??? I think it this alone tells us how important we are at this particular time.

Is it really possible NVC will be taking 90 days to assign numbers to IR-1/CR-1 cases? That would be a nightmare to say the least.

I think you are ok as long as you don't have the misfortune to get transferred to TSC!!

That's what I told the NVC phone representative I was going to do when I called earlier today, and she replied, "Well, you have that right". My "15 business days" are up on Wednesday, and I already have the e-mail sitting in my draft folder. Perhaps we should e-mail Bill Clinton; wouldn't want to take Pres Obama away from a Christmas party.

I'm a July filer transfered from CSC to TSC on November 3rd. I've called their number a few times since I was transfered. I asked them if being transfered meant I had to restart the clock again. Each time they told me that if I haven't recieved NOA2 within 5 months from the date that CSC recieved the application initially to call them and they would place a "priority flag" on the case. Three different level-1 operators told me the same. My 5-months are not up for a few days but I was wondering if anybody has tried mentioning this to the operators.

Regardless.. CSC TSC VSC are both in a holding patern as per the November

back log of cases for I-765 and other I-821 are protected status visa

and come pritority over everything else.

All service centers are on hold for all CR-1 and K-3 andK-1 & I 129 visa.

Since people keep sending in I 129 its causing the back up of claims.

Many people are still submitting K-3 and I-129 but they have been dead

since Feb 2010. So they been spending time to process them until they

die after processing them and they convert into the CR-1 with the I-130.

Many people dont do research and just do there own thing, thinking all is

fine and its not.

It's not just Vj-filers its the whole country of people just doing what they want

instead of following the new law. Yes USCIS is glad to take all money and

process I-129 with K-3. But they have hurt the system since the CR-1 really

took hold. Now the back up is growing and now it hurting many people who

filed correctly. Yes there are some CR-1 and other creeping past only

becasue they are slam dunk processes and dont require any thing special.

But everybody now on hold and who knows for how long or when it will finish

and TSC begin there processing again. There must have been more than 5000

CSC to TSC trans and now USCIS is waiting for all the SC to be at the

same level and time schedule.

So now we all are on holding pattern until maybe next month after the holidays

I also heard they are starting from TSC November 1st date as the 5 month time frame

some of you maybe have been told who contacted the TSC or USCIS site to

wait until 180 days are past before inquiring about your case.

If nobody is giving any information than it mean the people answering the

phone have been instructed what to say for the whole country... and that why no real

cases have been approved. another week until next week will prove my case.

If there are not a mass amount of approvals next week than I beleive it holds true

my statement that after or some times next month they maybe will begin to start

processng approvals again. Until than better just relax. Nothing we can do ! ! !

I thought the same thing. Actually we can write to the president. We can let him know about the discrepancies, difficulties and emotion setback we are having because we July filers are left out, when September filers are getting approved. If I write alone, I will have no voice. However, if everyone writes to the president, we might have a shot because we will have a same voice and concern. I have seen him reading a letter from a 9 year old girl. Why not we next? There is no guarantee that we will be heard, but at least, it is better to give a shoot. We will not regret that we have not done enough to be with our loved ones. We deserve to be together with our loved ones. The address for the president is:
