wonder if they have approved your i-130 and touches on your i-129f is closing it...

hey gang, i hope each and every single one of you is doing well!

just an update-

i received an NOA yesterday (12/04/2010) via snail mail basically reiterating the same info from the email I had received on 11/29/2010, regarding my I130 being received by a USCIS office from the State Department for review.

Online, my I130 remains in the "Post Decision Activity" phase.

So here's a summary of my timeline:

08/09/2010: NOA1 (I-130) Received text & email with case number

08/26/2010: I-130 Check Cashed by USCIS

09/09/2010: NOA1 (I129F) Received text & email with case number

11/02/2010: Cases Transferred to Texas

11/04/2010: Both cases touched

11/28/2010: I129F Touched- Received text and email saying case is being processed at a USCIS office

11/29/2010: I129F Touched

11/29/2010: I-130 Touched- Received text and email saying Case Status changed from "Initial Review" to "Post Decision Activity"

11/30/2010: I-130 Touched

12/01/2010: I129F Touched

12/04/2010: Received letter via snail mail stating I-130 was received by a USCIS office from the State Department for review.

i know how a few (all?) of you are getting discouraged and disheartened being forced to stay apart from your loved ones for so long- i'm right there with you. however today, as i was speaking with my queen via Skype, i couldn't help but be thankful that, since we must be apart for some time, at least it is in this day and age when we can see each other face to face, live, albeit via a glossy computer screen. point is, i reminded myself that things could always be worse- we could have existed in an era (not too long ago) when even a rare brief phone call would have been seen as a luxury experienced by very few.

Absolute nonsense - USCIS is processing your I-129F, but dropped their ball on your I-130. As you may know or remember, I have also received a post decision activity and hard copy letter this past Friday reiterating the very same thing as in the automated email that State Dept returned case to USCIS for a review. Makes no sense of whatsoever and your timeline and process even further supports the USCIS making a mistake with those post decision activity reviews, since they are processing one of your application, but not the other. Total screw up! Hopefully, they'll resolve this as quickly as possible and send us NOA-2 approvals and further onto NVC, embassy, and NORMAL LIFE at last! Good luck y'all!

Ok, so people, I don't think getting discouraged or sad will help us nor getting angry will solve this. But the same way thinking from opposite side,,, keeping only positive attitude and do nothing except wait also will not help us from getting out of this situation.

So please take the whole issue positively (atlease don't take it negative) in addition to have a positive attitude and suggest a solution to resolve this situation..

Guess:::

Is it possible that they switch the pile of files and send the first pile to NVC and second pile to 2 month waiting closet ????? Point is they put June,July filers in 2 month waiting closet (the fact is these files are almost processed and just need to make decision) and August files to NVC (without processing) and then NVC (NVC is department of State) sends all these files back to USCIS because they are not been processed.

What happens now, August filers are getting Post Decision Notice and says Department of State sends back these files to USCIS to review again. And If we June/July filers call them, we will be told to wait for infinite time>>>>

THIS WAS JUST A GUESS.... GANG, PLEASE DON'T GET IT NEGATIVE AND TRY TO SUGGEST WAY TO RESOLVE THIS.

Well, since my last post, there has been no touches on our I-130. So I'm in the same boat as all of you. But there has been one VERY positive development. I couldn't wait to see my wife again, so I went back to see her for her birthday and of course my own. I returned to the US from that visit on November 21.. wishing that I could have brought her with me. And we're staying positive, but now I can only hope that we are moving along. As she told me last night, I'm going to be a father.. :) Seems our visit was a bit magical!

Everyone keep being positive.. :D

At least I'm going to be more positive then ever now, Seems that my Christmas gift came early this year..

I have a question... last week, I receieved an email/text that said...

Your Current Case Status for Form I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Post Decision Activity

On November 29, 2010, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

AND... I just received a letter in the mail as follows:

I-797C, Notice of Action

This is to advise you that we have received the above application or petition back from the Department of State, along with their request that it be reviewed. We will notify you of any action we take on this case.

What does this mean? Is this NAO2? Have we been approved? What is the next step, interview? Sorry for the questions but... this entire process is a little confusing to me.

A few people have received this same message but they haven't gotten anything else yet. You might want to call customer service and see what they can tell you.

UUUGGGHHH....

I called USCIS... got the runaround... asked to speak to a Level 2.... more runaround..... basically, they told me that the application (I-130) had been sent to and returned from the State Department/NVC. They couldn't give me any more info... other than a bad number (typical).... so, I found a number to the State Dept... but, after 5,000,000 voice recordings... ended up with a phone that rings forever (with no answer). The saddest part is... USCIS told me they received the application back from NVC/State Dept... and they don't know why... BUT.... they do know that it could take up to 6 more months before it goes back to NVC..... it's so frustrating.... I don't know what to do. :bonk::crying:

A few people have received this same message but they haven't gotten anything else yet. You might want to call customer service and see what they can tell you.

When I applied for the i130 I used my maiden name. Since then I have changed my name to my husband's on my social security, bank, work, school, and driver's license. I haven't changed it on my passport because I have my French Visa, my French Immigration card in there, and plenty of POE stamps, and I'd like to keep my passport until it expires (I know it's fraud to have 2 identities with 2 different names) anyway I was wondering should I use my new name for the NVC step or my maiden, birth certificate name.

We too are August filers who got sent to TSC on 11/4 and then got the notice that it had been sent to a "USCIS Office" on 11/25. When I called last week, I did get a level 2 person and he said it was still at TSC and that it had never left. From what I can see, TSC is pretty screwed up and are probably enterring status codes to the online system incorrectly.

Accordingly, I question what really happened to the petitions for people who went from the "initial interview" status to "post decision" status. This is not a "normal" progression and many people got this update. I am guessing that one of the following 2 things happened:

  • They never really left TSC and agent(s) enttered incorrect status codes.
  • They were incorrectly forwarded somewhere and then returned and are continuing to be processed in the normal manner.

When I called the USCIS about our transfer (to a USCIS office), the person that answered the phone (level 1?) said that he did not have access to my actual case file and would need to "escalate my call" (to level 2?). The second person actually looked at my case and said, "no, it had never left TSC".

I mention this because if you never talked to a level 2 person, he/she wass not actually looking at your case but was giving you a scripted answer of some sort.

Do you know what the status of your petition is now? If it's back to "initial review" I think you are good to go. If not, you might want to try to call again. In my case I simply told the 1st guy that the online system said I was transferred to a USCIS office, I had never gotten the notification in the mail and I would like to know "which office" my petition was in. I never asked to be transferred but, based on that request, he escalated the call.

For all people calling USCIS: - I DO NOT Recommend using words that request a level 2 person. Just be humble, polite and friendly and ask questions that you think will get your petition escalated. I know it is definitely based on what agent you get but if you are not getting what you need and they don't escalate your call, simply call back and try different wording. Again...the answering agent does not have access to your specific file. He/she probably has the same status info you do and is tasked with explaining what that status/info means. He/she is probably also tasked with minimizing the number of calls escalated to a level 2. The key is for you to engage the agent in such a way that he/she believes you have a need for a level 2 and he/she WANTS to help you get there. (Obviously, just my 2 cents, as always).
