excellent explanation! also K-3 is good option in a case where AOS wont be done (i.e. not planning to live in USA permanently) and in some countriies can make a difference in what embassy/consulate you are interviewed (one far away does immigrant visas, one local does non-immigrant).

on the messages people are getting i.e. USCIS has rec'd from a State dept versus it's been transferred to a USCIS office for processing (even though the notice of transfer to TSC has already been sent)... i'm confused on what they mean. the latter (USCIS for processing) means they are just working on our petition and really isnt indicative of status (i.e. approved, denied, rfe)??

IMO, I think that is a software glitch from TSC. All these messages must be ignored.

Some people with "Post Decision Activity" by email might have already had a decision (a decision can be approval/denial, but most people will have APPROVAL). If they already approved and unable to track USCIS website properly or no clear emails, NOA2 will show up by regular mail in a week time. This is what happened to me. USCIS site didn't update properly and didn't have any emails too. But, within 5 days, I got a surprise NOA2 by mail.

Yes, your other point is valid too. For some (again some), they don't want to immigrate to the U.S, K-3 will give a non-immigrant residence for few years (I think 2 years).

But most (I would say 99% or more) will hit with I-130 and I-129F approved together. Then NVC will kill K-3 path.

Lol! The K-3 is not killed simply because they are approved on the same day. I just posted the info explaining that in my earlier post. It will only be killed if the I-130 is approved first or hits the NVC prior to the I-129F. So, since neither one of my petitions have been approved yet, it's still very much possible for my I-129F to reach NVC first. So, I'm choosing to keep hope alive. :-)

I agree, I mean, doesn't it say on the website somewhere that it's still in its testing phase or something? When I get my NOA2 hard copy I will hug my mailbox.

Hope what you wish. I was simply asking for what exactly are you hoping? It wasn't clear. If you're hoping your I-129F will result in a K3 visa, that's fine. Why is it you want that? There ARE some good reasons. I'm wondering what yours is.

I think you are wrong. If both petitions are approved the same day, so what's the point applying for both? Think about it.

For years it was that i-130 took longer to approved, that's why people filed I-129! But now because the process for I-130 is faster, there is no need to file for I-129. So if I-130 gets approved faster than I-129 they just cancel I-129. At least this is what I read.

i saw on web yesterday, then rec'd email last night, re: our i-129f that it is being "processed at a USCIS office" but web still shows initial review on both i-130/i-129f... dont know if that means they are simply processing the petition or if a decision has been made and they just sent wrong message out.

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

but he is also correct in that if they are both approved and sent to NVC when they see the approved i-130 the i-129f/k-3 will be closed. (because they ASSume it is "better" for us)

if you do get a k-3 approval and in meantime get i-130 approval do NOT tell them ... just set the k-3 interview and go. (if you NEED the k-3, otherwise go with i-130)

i saw on web yesterday, then rec'd email last night, re: our i-129f that it is being "processed at a USCIS office" but web still shows initial review on both i-130/i-129f... dont know if that means they are simply processing the petition or if a decision has been made and they just sent wrong message out.

IMO, All these emails and site update is not always reliable.

If any email comes or site update happens something like - "This I-130 Immigrant petition for foreign beneficiary has been APPROVED." - then we can confirm it. Key word here is "APPROVED".

Other option is just wait for the snail mail.

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.
