Got the email from Officer Garza about a week ago and yet my case still hasn't been touched after the email. Sad part is I had a dream last night that I received an email stating my case was approved and then I woke up, checked my Iphone and nada. This situation has gotten me and wife depresses, stressed and frustrated and the same time. This has been the worst experience I've ever had so far. All I want is for me and my wife to be together.

I hear you,my husband and I,we are so frustraded also. You're not alone.

I give up waiting for tonight. I am too tired, upset, and angry to sit here and wait for a small shred of hope for an approval. I wish you all the best of luck tonight.

I say congratulations to you, Mike. You just dunno how you bring out hope in my family today. Every approval, and everytime someone gets through NVC in this thread is a celebration in my family. When I announced- "someone from TSC got through NVC!!", my husband said YES!!!

Just got a call from our Congressman's office. And just like most of you, they are asking us to sign- I guess something abt Release of Information- for all it's worth, and to exhaust all means, I wish it will do miracles.

Thank you very much for your kind words. The way I see this this horrible wait and separation does have one positive, my wife and I will have much more appreciation for the simple gift of being able to be physically together. I think that a lot of people do not appreciate what a true luxury it is to be with someone you love. I see a lot of my friends fight with their significant others and want to get away from them. I've told them "Man, at least you can look them in the eye and talk about it, kiss and make up afterwards. You don't have to do it over Skype or an instant message." If anything this will bring us closer to our loved ones and make our relationships stronger. Always keep that hope and always remember why we're all enduring this torture. Good luck to you and your family.

-Michael

I see this now. Thanks for the info fermat. Obviously the IRS agent that I talked to either misunderstood my question... or his head was up his assets ;)

Thanks again.

Erick

Think about it. If you were filing married seperately or single you would have to report your foreign income. Whether you are a USC or an LPR. If you're filing jointly then you are opting to treat your spouse as a resident. Of course your wife did not pay taxes to the US government in 2010, that is the point of filing out the tax return and sensing by April 15, 2011. That is when you pay the taxes you owe the government, not before. Just because she did not pay in 2010 does not mean she does not owe.

Here is the link: http://www.irs.gov/b...d=96370,00.html

Here is the text from the 3rd paragraph addressing this issue:

Generally, neither you nor your spouse can claim tax treaty benefits as a resident of a foreign country for a tax year for which the choice is in effect and you are both taxed on worldwide income. However, the exception to the saving clause of a particular tax treaty might allow a resident alien to claim a tax treaty benefit on certain specified income. You must file a joint income tax return for the year you make the choice, but you and your spouse can file joint or separate returns in later years.

ROFL... unfortunately yes, it seems so.

Hehe, thank you! I had fun :D

That's weird, cause I asked the same question to an IRS agent last week and she told me that my husband would have to report my foreign income. Oh no, the IRS is starting to resemble NVC operators who give out conflicting information blink.gif

This thread seems to have the most cumulative coverage of the tax situation along with responses from accountants and someone who has used turbo tax with the options that we will need to use.
