2/9/11- NOA2 (transferred to Texas)

NVC

2/28/11- case number received

3/2/11- Paid AOS bill

3/5/11- Paid IV bill

3/12/11- expedite to Bogota consulate approved!!!

3/14/11- left NVC to Bogota for further processing

3/17/11- received by Bogota, emailed consulate and was told to send DS-230 and DS-2100 (packet 3)

3/18/11- packet 3 emailed to Bogota consulate, email confirmation on March 23

3/31/11- Interview date! Approved!!!!!!

Think about it. If you were filing married seperately or single you would have to report your foreign income. Whether you are a USC or an LPR. If you're filing jointly then you are opting to treat your spouse as a resident. Of course your wife did not pay taxes to the US government in 2010, that is the point of filing out the tax return and sensing by April 15, 2011. That is when you pay the taxes you owe the government, not before. Just because she did not pay in 2010 does not mean she does not owe.

Here is the text from the 3rd paragraph addressing this issue:

Generally, neither you nor your spouse can claim tax treaty benefits as a resident of a foreign country for a tax year for which the choice is in effect and you are both taxed on worldwide income. However, the exception to the saving clause of a particular tax treaty might allow a resident alien to claim a tax treaty benefit on certain specified income. You must file a joint income tax return for the year you make the choice, but you and your spouse can file joint or separate returns in later years.

Hi everybody, let's pray fro approvals this week!!

I have a question, Do you know if its necessary to change passport if all the other documents reflects your husband name? I am doubting, because my passport has my maiden name and at the NVC they ask for the biographical sheet of passport.

If this is a question of what name the visa will be issued in, then YES you need to change your passport. The visa is issued under whatever name the passport says. If you are the US citizen, remember that they do not ask for your biographical sheet of passport...only your husbands. I am not sure if I understand your question.

I am the beneficiary, and that is why I am thinking to update or change my passport, because they ask for the bio sheet and I supposed that the visa will have the name on my passport and it'll be better if it has my husband last name

Sad part is I had a dream last night that I received an email stating my case was approved and then I woke up, checked my Iphone and nada. This situation has gotten me and wife depresses, stressed and frustrated and the same time. This has been the worst experience I've ever had so far. All I want is for me and my wife to be together.

Yes it's so hard. I hope there will be approvals this week. Don't be bitter or sad because it won't change the situation. It'll all be over one day!

And last night I had a dream that I had a charge on my bank statement for $404 from NVC and that I had already been approved and paid and just hadn't realised. Then I woke up.

To wait 90 days after approval and just then start inquiring why our case wasn't sent to NVC!! Can you imagine 3 months it takes for them to sent approved petitions to TSC!!!! Huuummmm... So you better be patient and don't give up, coz although TSC approves them, it will take many days to reach NVC, unfortunately :(

All, keep posting all the roadblocks and inconsistencies that we are encountering. Well according to the tier 2 person my husband talked to last week we are suppose to recieve an aproval or not by lattest March 4th. But then again, I dont know if to believe it or not....

wacko.gifAll this has me flustered. I took another look at my I-797C and the Priority Date is July 2nd, 2010, instead of July 8th. I was told several times on the phone by USCIS that my Priority Date is the 8th.blink.gif

I-130 NOA2: February 10th

Sent to NVC: February 11th

NEGATIVE....

According to the dude (man) at the IRS office yesterday.... you do NOT have to claim your [out of country] spouses income on your return if you are filing jointly (with ITIN). The reason being.... they didn't pay any money(ies) to the US Government (IRS). The exact example that I gave him was....

"My wife is in Brazil, we are currently going through the immigration process. She has not lived here or earned any money here (in the US). Can we file "Married/Jointly"? He said .... YES....

Next question... Do I need to include my wife's (foreign) income on our tax return? He said.... NO, she did not pay taxes to the US Government... so, NO... you do not include her income.

Makes sense to me.... but.... if you have different info... please let me know before I go through this lengthy pain in the butt process of ITIN...
