Recall that our transfer notices were sent November 3rd. That means that they at least had ALL of September petitions and ALL if not MOST of October petitions in their possession when they made the decision to transfer JJA cases. It may be the case that they did not have Sept/Oct cases put into the system and that CSC actually did transfer the 35000 NEWEST cases to TSC, and that happened to be all of ours. Even then, they could have instead made the decision to forward all NEW cases to TSC instead and while TSC got prepared to work on them, they would have accumulated 20,000-40,000 petitions from November/December. Petitions that would now be 1-2 months old instead of ours 6-7 months old.

I'm not a lawyer, I'm just a guy who likes cats. But in my opinion is not so much about the 2 months delay (thats a conservative estimate for my petition). It is about their decision to transfer their oldest cases (June/July/August or JJA) on hand to a new service center that didn't have any experience processing I-130s and was evidently understaffed and/or ill-equipped to handle the work load. No chance that those cases would be touched for at least 3 months, and they should have known that. What should have been done is to forward all NEW cases to TSC, or transfer the 35000 newest cases instead of the 35000 oldest cases. That way, all cases would probably still be completed within 5 months. They way they chose, they guaranteed that all JJA cases would be done in 6-8 months while other cases would be done in 2-5 months. Seems to me that goes against their mandate to process cases in the order that they are received. Certainly what they did was unjust, but I don't know that it constitutes a lawsuit. I know that civil cases follow a different set of rules than criminal cases. I'm certainly willing to look into it though.

I am pursuing all avenues to bring attention to this whole USCIS fiasco. Just so you guys know, there are some media outlets that I have contacted that are following our situation, unfortunately I cannot name who they are at this time. Lets just hope that some of them do follow through on exposing the poor management and customer service in place at USCIS.

Contacted national and local media by way of "farming" email addresses from the Internet, feedback forms and immigration articles that I can track the article author down, Twitter has been pretty good as well. I have been providing links to this thread as a whole as well as some specific post in this as well as other threads. They are watching, it just depends on if/when they will pursue it.

im guessing nab got banned. Anyways, back to the thread...fermat, I completely agree with what you said and I have said that all along. Why didnt they transfer NEWER filers so they would still be within the 5 month processing time? We will never know, but it was an unthoughtful decision for sure.

It seems that they were operating under the assumption that TSC would be able to get to work on approving them immediately. If TSC had had the manpower, competency, and time to devote to the 35,000 petitions, it could have worked out very differently for us (considering that CSC was able complete 19,000+ cases in November). But as it is... not a very well thought-out plan.
