Same here. I called two days ago and talked to a really nice and professional CSR. I told her I had two concerns:

1. Why did my online status go straight from Initial Review to Post-Activity Decision without stopping at Decision. (Made me think there was a screw up at TSC) - Go figure :P

2. Why did I receive a notice stating that my application (I-130) had been returned (from the State Department) back to USCIS without ever receiving my NOA2.

According to the CSR, we were APPROVED, but the State Department found errors and returned it to USCIS. She put in an SR to have the Approved NOA2 sent to me (within 30 days). Unfortunately, she couldn't tell me what the errors were and to give them 120 days from the date of return (29NOV2010). I still don't think it was ever approved... I think someone just pushed the wrong button on the computer (see concern #1 above) but, I am trying to stay positive. At least now I have a SR number that I could roll up and poke them in the eye with.

Do any of you have any idea why the State Department would return the application to USCIS? I am assuming it was something they did incorrectly... I would like to think if I made errors that USCIS would have already caught it and sent me notification. It is really going to suck if they take the entire 120 days and then send notification back to me for correction.... then the process starts all over again. As it is... it takes 4-7 months for the Consulate in Brazil to set up interviews. It's already been 7 months since I've seen my wife.... I sure hope it doesn't take another 8-10 :crying:

Congratulations! Let's see some more action, TSC!

I know your question was for someone else, but I just put in a service request yesterday and can tell you my experience if it helps. The tier 1 that I spoke to was able to put in the service request for me (but it sounded like she first needed to see if the system "would let her" put in the service request). She confirmed that the processing time is indeed five months, and when she asked when I filed, I asked her if she wanted my received date/priority date or my notice date. She let me give her my priority date, which was great because my NOA1 took so long (19 days). She gave me the standard "someone will get back to you in 30 days or less, and you can always call back with questions, etc." I think I'll give them a week before sending an email to the follow up address.

She was quite nice, and I didn't complain or ask questions or say anything about this whole TSC mess because I know that tier 1 people don't tend to tell you much that is meaningful, and it seems like escalating doesn't lead to satisfactory results anyway. I don't think the service request itself will do anything, but it seems like a necessary first step and at least now I have a referral number to use when I send my follow up email.

I'm calling my congresswoman's office again tomorrow (I left a message today on the immigration caseworker's answer machine), and I've drafted a letter explaining the situation and requesting assistance.

Sorry I'm feeling silly tonight!

I feel I should be more patient due to our situation. This June makes 6 years since me and hubby met! We have always had a long distance relationship. When I tell people that, they are amazed. It has been SUCH a process. We are married we have a beautiful son together and now it's just time to be a complete family.

My son (who will be 3 in May) is now always asking to go on the plane to see his dad, he says he misses him and gets so sad somedays, it breaks my heart. Skype can only do so much justice. Our three week visit over the holidays wasn't enough (although I'm very grateful for that) I wish we could see each other every weekend. I often wish he lived in New York, me being in Toronto, I would take the drive/ bus and see him all the time. However, Miami is not a simple drive or bus ride away. It's becoming so expensive to fly. When our son was younger it was easier, plus being on maternity leave for the year, I pratically lived in Miami, gone for three months back in Toronto for a little and gone again. I took advantage of my time off. The first year was nice, but the visits now are not for as long, and not so close between, not to mention having to pay the full fare of my son now since he turned 2 has not been much fun.

I'm rambling and sharing useless info with you guys. I'm just reflecting on how long this process has been on a whole for us, I don't even know what I'll do with myself when everything actually starts falling into place. I will be beside myself. The day that I move will be surreal...waking up to my husband everyday for the rest of my life...it'll be heaven on earth!

Yes, they should process them in the order received and they just might be doing this. Depending on the level of competence of the individual assigned a case load may explain why approvals are scattered as well as some cases do require a bit more attention then others.

Personally, I see my case as pretty straightforward. Married 2+ years, wife resided here in US for a time, our son was born here, I nor has she been on "America's Most Wanted" or "Cops".

We were approved for an expedite due to our sons health issues while in Thailand with my wife, blah blah blah.......I see no logic as to what the hell is going on.

I have always said, they need former and/or retired Military personnel to run some of these agencies, they would kick some #### and take names, at least I would. I have no patience for inefficient and incompetent employees.

If I don't get an approval by tonight, I have no idea what I may end up doing. Maybe I will pitch a tent out in front of the CSC In Laguna Niguel, about 20 minutes from my home, call the press, maybe that will get some attention?

Top of the morning Erick! In all likelihood, your application had never left the Texas Service Center. Therefore the State Department had never received it. Therefore the State Department had never sent it to a USCIS office.
