I think you should refile as per Laurel Scott's suggestion.

After all the researching and emails sent this weekend, I feel like I have hit a wall physically and emotionally. Skype'd with wife and son this weekend, she is a wreak.

It makes it that much harder to deal with when the spouse does not totally grasp why it takes so long and you have a child that keeps getting ill. All she hears is Expedite was approved, why the hell is it taking so long. Expedite was approved 77 days ago, go figure.

She is in a very rural area of Thailand, if I could afford it I would relocate her to Bangkok until this ####### is resolved.

Hey guys just want to share the latest email from my lawyer!

I, too, am very frustrated at what is taking USCIS so long to adjudicate your petition. I called them last week to check on the delay and was told that Jonathan would be receiving correspondence from them in response to his service request. Please let me know if he does not receive something from them by the end of this week because I will then contact the attorney service liaison to force a response. The only thing I can think of is that they are confirming Jonathan’s birth abroad to a U.S. citizen or they are just so backed up.

As soon as we have the approval, we pay the consulate for the appointment, provide the consulate with the additional forms and documentation, and then you will be scheduled for your interview within a month or two. I am ready to push this through as soon as we get the approval. I know how desperately you need to get home.

Please take care and let me know if Jonathan receives the response. Thank you.

So, what's the thoughts on any approvals today gang? It's Monday - do approvals ever happen on Monday? Judging by the HUGE gaps in our VJ spreadsheet, and the average number of VJ people approved per week since Christmas, I would say that we could be in for a long wait. (Unless the damn bursts).headbonk.gif

(1) When one looks at the numbers of approvals coming out of the TSC, it is more indicative of a change in policy than an overload. The output number is just too low, almost indicative of a rotating work stoppage or priority re-structure.

Based on already discussed factors, and analyzing some of the facts at hand, it appears that they are conducting something of a rolling black-out, to put it in electricity terms. By this I mean that because of high numbers of applications for many types of visas, they are rotating resources - one month one type gets more focus, another month another type. That would explain why some August - September filers have been approved, and many June - July filers have not. This analysis does not help us in any way, but at least it made my brain feel like I was beginning to figure things out. :wacko:

Very good observations, and ones I have also considered. My thoughts wonder if there is a deliberate attempt to slow the petitions down, orders from the very top maybe, who knows. I know what you're getting at regarding the rolling black out. They are spreading resources in an already overloaded workplace. My worry is, that, using the VJ spreadsheet as a snapshot, they are going to be nowhere near completing these I-130's before the end of February. I mean, on here, we're seeing only 4 to 5 approvals per week. At that rate, with the amount still outstanding, we're going to be here until August! I hope I am wrong on that, I'm just using the statistics available.

As for WHY CSC sent 36,000 petitions to TSC, well, the letter said TO SPEED UP PROCESSING. Unfortunately, it didn't quantify that WE were the ones who would be processed quicker.

Totally agreed I seen August-September cases that have been approved and June- July have not at all Im on the June ones and I was trying to figured that out.. theres just to many questions that i guess we will never know

The cynic in me says they are aiming at damage limitation, and backing an already upset group into a corner. I mean in their eyes, is it better to have 10,000 screaming June/July filers, or 30,000 screaming June/July/August/September filers.

Statistically, an overload of applications / petitions would create a curve where output would INCREASE until a saturation point is reached, and the output then levels off at a higher than normal level. From what I have seen the output has dramatically reduced, at least for I-130s. Hence my theory about rotating resources or a policy change.

I read somewhere that consulates are getting massively backed up, and that may have triggered the USCIS slow-down. BUT, those of us who do not need to worry about priority dates should not be lumped in to this, as it appears we have been.

If anyone has an update on any output data let me know.

you know you have a really good point and i wish they could see things the way we do or just even go with each case as how it was file by date. I would think that would just make things a lot easy is just like when you waiting on a line you'll have to wait till you turn is up and that how it works every where but I guess that point right now has been left way back
