how long did it take after that? did they say they were 'pulling the petition' to send it there or that it was already there? i recall at least a couple being told (in addition to me) that ours were being pulled and would be 30-45 days...

as for our congressman , i was truly disappointed because the gal dealing with this truly doesnt know the process or the centers, and obviously didnt even read the underlined portions of my letter (i didnt expect anyone to read the whole thing - 2pg - so underlined the main points which was approx 6 lines per page. THAT was truly upsetting because our congressman has a reputation for helping people and i tried to make it as easy as possible)

well hopefully you get approved, but what i was going for was comparisons in people "already approved" to see if there is a pattern there so that others can follow in their footsteps.

it sounds like (and know that i am just guessing!) maybe you were in that batch of people who were told they were 'approved' 2 months ago and cases were supposedly sent to NVC and then sent back because they werent processed properly, probably because TSC has not processed I-130s in long time and didnt know what they were doing.

if you are over your 5 months processing time you DO qualify for an outside of processing time expedite service request # and i would get that, document that as well as the calls made (just like you did above) into word file or notebook and keep documentation as proof of contact with them that you were not just sitting back doing nothing.

Where can you find information about this? Never heard of it.

Sure Ron. When she's around I'll ask how she got through and post it on here. Might it be by hitting * then 0? I'm not sure - I didn't call myself, but Val did many times before Christmas. good.gif

As for the email, yes, I normally get that same message back as you, but just once, or twice I have had differing responses, so the mails do get through.

Hey Ron...Val here.......all you have to do is dial the USCIS number, hit 1 for English and then hit *1......it will take you directly to customer service and then you need to ask for a tier 2 person.....I think I called at least 50 times from the UK.......headbonk.gif I must know every customer service rep there...lol

I got that last letter from my congressman on 1/7, I believe. I don't have the letter with me but I think it said something like it was going to be sent to that exams unit for review. I didn't make contact with his office or with USCIS after that.

Oh, and my husband and I are both 25, married for a little over 7 months, no children.

"...you DO qualify for an outside of processing time expedite service request"

Hi

I dont know if your able to have and expedite if your pass the 5 month time, just because

your past 5 months. But USCIS has a 6 month time frame to process I -130. 5 Months is just

the time frame they try to meet. It's not in GOLD they have to approve at 5 months.

You CAN do a expedite if you have a qualified reason. FINANCIAL OR MEDICAL

EMERGENCY TO BE CONSIDERED FOR EXPEDITE IF YOU HAVE DOCUMENTS PROVIDNG YOUR

PROOF OF EXPEDITE. NOT JUST ANYBODY CAN OR WILL GET AN EXPEDITE.

USCIS reqirements to EXPEDITE

REVIEW THE USCIS EXPEDITE CRITERIA.

Visit the official USCIS web site. According to the USCIS (Department of Homeland Security),

cases may be expedited if they meet any of the following criteria:

- Serious financial hardship

- Humanitarian situation

- Extreme emergent situation (emergency)

- Matter of national interest or security (Request must be made by a US government official)

- USCIS error or compelling USCIS interest

- Request by non-profit organization for the sake of US cultural and social interests

Check if your personal situation meets the requirements. For a family-based or marriage-based

visa like a K1 visa or I-130 petition, the grounds for an expedite request may be: a medical

emergency, an impending military deployment of the US petitioner, terminal illness, political

instability in beneficiary's country, etc.

Good Luck
