rather than try to find a link on why we were sent to TSC, let's find a link between the approvals...

not all got an email from that same officer garza and not all who rec'd an email from her/him got an aproval

is there any other pattern??

are all i-130s or were there i-129Fs as well? are all beneficiarys/petitioners young/old, been married long/short time, have/dont have children, got senator/congressman involved.

the latter one sticks out at me more than anything, because of what they say when you follow up with their office: "they said they will pull the petition and give a decsion in 30-45 days"... how many people have been told that? were the ones who were approved told that as well? is TSC not even working on them till they are prodded like this?

The only pattern I saw (if you can call it a pattern) is that both Rickey and I got the same response from our congressman that our petitions were sent to the exams unit of TSC for processing and to wait 45 - 90 days for notice of action.

Well OK. I'm older, been married, dont have children, senators contacted no reply yet since December 12th in Ca.

Congressman replied in 3 days and said give 45 to 60 days reply 3 weeks ago, but not 30 to 45 days and was headed for exam room for review.

Good Last question about if they approve them until they are force to have too. Well that to early to be seen yet.

My Attorney said TSC is all messed up and lost about I-130 but feeling before not to long they will have to approve. :)

or they will get farther behind and never catch up.

OK, I when I called at 11:11 EST I got a different menu item after inputting my receipt # which allowed me to talk to a representative.

As expected, they weren't very helpful. Here are some notes:

Level 1 - speaking with Monica

  • Said that my petition "was approved" but sent back to the State Dept for additional review
  • Said that I should allow a minimum of 120 days for processing since the notification of transfer from the State Dept (Nov 29)
  • Said that the case was sent back from the NVC (wait, what? Is this the same as the State Dept?)
  • I confirmed with Monica all the information she had given me, including that my case was approved. She confirmed.
  • I pointed out that although she claimed I was approved, I never received any notification stating this.
  • Monica transferred me to the next level of customer service

Level 2 - speaking with Officer Shankar

  • I told my story, along with the claims made by the previous customer service attendant
  • Was asked for receipt #, name, date of birth, address
  • Said that the case was "never approved", and that it was sent back from the Department of State for further review
  • I asked about being outside the 5 month processing time. Officer Shankar said that 5 months is just an average estimate, and that cases can take longer
  • Confirmed that there was "no decision" yet for my case, and that it needs additional review
  • I asked at what point the Department of State gets involved in the process, as I thought the next step was to go to the NVC. Officer Shankar said that the Dept fo State can get involved at multiple points in the processing.
  • I asked for an estimate of how much longer I should wait for a decision or further notification. Said he couldn't give any estimate.
  • I asked if it is normal that my case was transferred from California to Texas. He said such transfers are normal.
  • I asked at what point I should call back with questions about my case. Said I can call back at any time if I have questions or if there is a problem with my case. I asked how I can know if there is a problem if there is no timeframe to base it on, and no notifications sent to me. He said he is sorry that he cannot give me a timeframe, but I can always call back with more questions.

Officer Shankar had a very calm and relaxed voice. It is quite remarkable that he can keep that tone of voice while he knowingly gives me no useful information yet offers that I call back at any time with more questions. I only have one question: when will my case be finished! I want answers, and action!

After all the researching and emails sent this weekend, I feel like I have hit a wall physically and emotionally. Skype'd with wife and son this weekend, she is a wreak.

It makes it that much harder to deal with when the spouse does not totally grasp why it takes so long and you have a child that keeps getting ill. All she hears is Expedite was approved, why the hell is it taking so long. Expedite was approved 77 days ago, go figure.

She is in a very rural area of Thailand, if I could afford it I would relocate her to Bangkok until this ####### is resolved.

how long did it take after that? did they say they were 'pulling the petition' to send it there or that it was already there? i recall at least a couple being told (in addition to me) that ours were being pulled and would be 30-45 days...

as for our congressman , i was truly disappointed because the gal dealing with this truly doesnt know the process or the centers, and obviously didnt even read the underlined portions of my letter (i didnt expect anyone to read the whole thing - 2pg - so underlined the main points which was approx 6 lines per page. THAT was truly upsetting because our congressman has a reputation for helping people and i tried to make it as easy as possible)

well hopefully you get approved, but what i was going for was comparisons in people "already approved" to see if there is a pattern there so that others can follow in their footsteps.

it sounds like (and know that i am just guessing!) maybe you were in that batch of people who were told they were 'approved' 2 months ago and cases were supposedly sent to NVC and then sent back because they werent processed properly, probably because TSC has not processed I-130s in long time and didnt know what they were doing.

if you are over your 5 months processing time you DO qualify for an outside of processing time expedite service request # and i would get that, document that as well as the calls made (just like you did above) into word file or notebook and keep documentation as proof of contact with them that you were not just sitting back doing nothing.

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

today is day 204 and i'm losing my mind

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.
