OK, just got off the phone with a Level 2 CSR, he was actually helpful and courteous. He went through all the notes on my case and added more notes for today's call. When I confronted him with the fact CSC filers who filed after us getting approval now, he did not try to make excuses.He said that they are aware of the TSC problem and recommended that I contact my Senator/Congressman, I told him that I was going to my Congressman's office this afternoon and have made contact with local media outlets.

So basically, no new news.

Why do I feel like I have been bent over and violated without any KY Jelly or a reach around!! Gotta add some humor to this fiasco.

I'm very much of the mind to do what fermat suggested. Fill in another I-130, get the medical documents, send a copy of the check, and resubmit. It probably won't get anywhere, but it would only cost the price of a stamp.

We know their system is obviously broken, personally, throwing in another wrench (I-130) will complicate it even more. They screwed up a transfer, imagine what they could do with this scenario. Just my 2 cents...........

I was thinking the same thing. It would royally suck if a second application were to get to CSC, get to the verge of approval, and then get flagged by some computer for "additional examination" because of a prior application. Say hello to an additional 8-12 month waiting period.

3/12/11- expedite to Bogota consulate approved!!!

3/14/11- left NVC to Bogota for further processing

3/18/11- packet 3 emailed to Bogota consulate, email confirmation on March 23

3/31/11- Interview date! Approved!!!!!!

I just got a response from Congressman John Sarbanes about my case only a day and a half after I emailed him. Here is the email he sent me:

January 19, 2011

Dear Mr. Carmody:

Thank you for contacting me about your visa petitions for your fiancee and step-son.

I have sent an inquiry to USCIS explaining your concerns and requesting a response. I was told by our contact at the Texas Service Center that your petitions were still pending adjudication. Apparently your petitions were received at the same time as 35,000 other I-130 petitions. However, I was told that a request has been made that your file be assigned to an officer and a response should be issued within 45-60 days. As soon as I receive a reply, I will get back in touch with you.

I appreciate the opportunity to be of assistance. If you have any questions or concerns, please contact Kristen Weiss in my District Office via telephone, 410-832-8890, or email, Kristen.Weiss@mail.house.gov.

With best regards,

Basically it's the same thing other people have been told with no results. Well, I don't know how much I believe that I will receive a response in 45-60 days after everything that has happened. I'm actually considering filing an I-129F and praying that it gets sent to Vermont and processed quickly. The last time I did an I-129F it was approved in less than 3 months.

Nice email, and yes, a very similar answer to others. The I 129F may not be a bad idea....we have one in...but...it's at TSC...
