Just file without the fee. It can't hurt.

because we are expedited, I think she is saying send another I-130, with out documents, and it should go through very quickly.

My problem with that is:

1. It costs money.

2. We could get turned DOWN this time for expedite and we'd be even further behind.

I think the REAL answer to the TSC problem is exactly as outlined by Jenny's senator (I think it was Jenny).

They got 35,000 cases in November, the took three weeks to input them, and they have been given 5 months to work on them.

Contrary to what our letter said about "speeding up", I feel our time HAS indeed been reset. It appears we can do nothing at all about it.

It appears we all filed on November 26th. We've been screwed people.

Yeap! that is what happened.. we have to wait another five months

Hey all, work's kept me too busy to actively participate as of late but I've been checking on you guys daily. Unfortunately for us, all signs do seem to point to our clocks being reset to some degree.

Politicians don't seem to be of any help in our case. I'm beginning to think the reason is because, as some of you have already alluded, this scenario has not played out before, and subsequently there's no standard protocol that the TSC is mandated to follow.

Of course I'm making all this up- it all pure speculation.

I've been calling the USCIS (against my better judgment) somewhat regularly. What completely baffles me is that I continue to get different information from both Tier 1 and Tier 2 Officers alike. Some of them, perhaps being cognizant of the conflicting information they're dishing out, get downright nasty when I inquire about the blatant inconsistencies in the statements I'm given regarding our situation.

Anyway, just wanted to touch base with my VJ family.

Cheers

Yes, when put on the spot by Val yesterday, the Tier 2 person simply hung up on her. Of course, we could get the names of these people, and report them - I have an email address to do that.

Looks like our TSC friends completed 400 cases that month and have 35,000+ pending.

I really hope you're right. I just find it hard to see how TSC can deal with 36000 July filers all at once!! Part of me is more optimistic though - I swing between optimism and pessimism....

I remember back in June before I got married I went to the U.S. Embassy in Asuncion, PY and the woman there told me it would take a year to get my husband to the states. I think I may just hope for that. I feel...burnt out.

Yes, a few June I think, and then July & August. I think it was mainly early August filers on here, and I know a number of those are approved.

Gary, I don't think it was reset, if you look at the graphs there are zero receipts, if it was reset then the 36000 would be in the receipts not in the pending.

If you call for a service request they actually say to wait 180 days from the date of your transfer to inquiry about your case when before that it said 180 from priority date. I spoke to a Tier 2 rep and we plain ask her because we file in July and it has been six months. They said to count from the date of transfer. It was not out of processing time. My husband clearly asked if we need to wait 5 months and she said it could be less but that was the official time frame. So that explains why our cases haven't been touched once since November 29 and still in initial review. I spoke to a friend who works for an immigration lawyer and she said it seems that yes it was reset when you get transferred just like the officer said. Unfortunately you are part of the batch it was tranferred
