On January 4th I filed a request to expedite my case citing USCIS error. Today, they replied by rejecting my request claiming I did not provide any evidence. Evidence? Really....

Seems all beginning July filers require additional review.

Tomas, we got the same response back in December, I ll check tommorrow the id of the officer in our letter, maybe it was the same person.

I am not USC and my husband is not proactive as i would want so he just accepted it. But I would forward this answer to tsc e-mail and demand explanations with facts such as "is my case assigned to officer and when".

if they give stupid reply again forward to uscis HQ. How it sounds?

You guys are lucky..... atleast you are getting reply from your congressman and senators. here in california, our congressman is not able to get responded by USCIS, he sent inquiry 45 days ago and still he is waiting for USCIS reply. Senator Barbara Boxer wants more detailed writings about the case, I do not know what kind of details she is looking for, I have explained the probelm in detail with page full of write ups.

They are made of the same ####### as of TSC people. TSC should be recognized by TFC--- Texas F*****g Center. That is exactly what they did with our files and lives.

You can add me to the spreadsheet of CSC->TSC transferees. Here is all the activity I've had so far on my case. (Note: I don't check for "touches").

  • Aug 21 NOA1 Notice Date (CSC) hardcopy (*)
  • Aug 16 NOA1 Priority Date (CSC) hardcopy (*)
  • Nov 02 Date of Transfer to TSC "for processing" on notification email
  • Nov 03 Notice Date on NOA hardcopy about Transfer to TSC "in order to speed up processing"
  • Nov 29 Date of "Post Decision Activity" "a USCIS office received this case from the State Department" email / web status
  • Nov 30 Notice Date on NOA hardcopy "to advise you that we have received [the petition] back from the Dept of State [for review]"

(*) Received this notice twice, for whatever reason, first postmarked Aug 24 and second postmarked Nov 03. Both are from the CSC.

Nov 30 was the last action on my case, and it was just now that I started getting worried and found this thread. I've just read all 127 pages of bad news. The optimism of this group overall is pretty remarkable, given that only one person of one hundred has really passed to the next step. It seems to me there's no telling how far out the average will be for this group, but I've moved my expectation date of obtaining my wife's visa from late March to early July, best-case scenario.

My 5-month mark from my NOA1 priority date was on Jan 13, so I've officially waited long enough to make my futile complaints, of which I will begin tomorrow.

God save us all.

Hmmmmmm, how about posting the edited contents of your letter so some of the other filers here can use it as a template. I have already done a letter to my Congressman, it is on my laptop which I do not have access to until this weekend.

BTW, I have had NO response from the Ombusman (it was an e-mail, didn't know about the form until after I sent it) or my Congressman. I have sent e-mails to local media but nothing has gained any traction yet.

Here's the email I sent to the Ombudsman on 04JAN2010... and as you can probably guess..... NO RESPONSE, not even an email stating that they received it:

Dear Sir or Ma'am,

I am contacting you regarding my I-130 application for my Brazilian wife (her name). I filed the application to Chicago Lockbox on August 09, 2010 and from there it was sent to California Service Center (CSC) with a NOA1 date of August 13, 2010. On November 2, 2010 I received notification that the application had been sent to Texas Service Center (TSC) to assist CSC in maintaining their 5-month approval timeline. On November 30, 2010 I received an email alert and notice that my status had been updated. When I checked my case status online, it showed that my case had moved from "Initial Review" to "Post-Decision Activity", and completely skipped the "Decision" process. A few days later I received another NOA stating that my application had been rejected from the State Department/NVC and sent back to USCIS. I thought there was an error because I never received a notification stating that we were "APPROVED/DENIED"; from my understanding, I would get an "APPROVAL" letter before it ever gets sent to NVC. This is the exact message:

Post Decision Activity

On November 29, 2010, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

I called USCIS to find out why it was rejected/sent back but no one could tell me. The only thing they could tell me is that it was rejected and that I may have to wait an additional 180 days and that I should call the State Department.

I called the State Department and they told me that they haven't seen it and to call NVC.

I called NVC and they told me the same... they had never received it and that USCIS must have made an error and sent the notification by mistake.

About every two or three weeks, I call USCIS back but always get a different answer. I've been told that the application was sent to NVC and rejected. I've been told that the application never left and that they made a mistake (that TSC normally doesn't work on these applications and haven't been properly trained). I've been told that they don't know what happened, to wait up to 180 more days. And.... more times than not, I've been told, that I was still within the 5 month window... and to call back in two or three weeks. Every person I talk to tells me something different.

I'm contacting you in hopes that I can find out the "actual" status of my case and get the "online case status" updated to reflect accurately. Even though I'm in the United States Navy, I know that I am still in my 5 month window (for another week)... and am not necessarily looking for "MILITARY/EXPEDITED STATUS" (although it would be nice), I just want to know what is going on with my application. If it was sent to NVC, why was it returned? Is it still in USCIS (never sent to NVC), if so, can they update the "online case status" to reflect accurately? If it did actually go to NVC, should I have received an "APPROVAL" notice?

Please understand, after 18 years in the US Navy, I've learned to always attempt to resolve issues at the lowest level possible. I would never contact you, had I not used all of the other resources at my disposal.

Thank you in advance for assisting me in this matter. I have also included my application/notification timeline below.

Yeah

Got your idea, i sent to US Ca senator Boxer, US Congressman Waxman,

President & the White House, TSC and Ombusman, from all of these

only received a responce from WAXMAN.

WAIT ANOTHER 45 to 60 days after than contact my office and I will assist

in checking again. That where it stands until February 20th and 60 days

are up i have to wait.

TSC office workers at some of the locations dont have the experience to

process I-130 and the system is backed up now. The USCIS.gov website

is under change and is down today, until its back up and we see the

difference will be nobody knows. CSC has processses & approvals ongoing.

My attorney said the president has cut backs in Immigration for buget reasons

USCIS system is breaking down an no sight as to when it will be working

like past years. Cut back in funding and employees who dont know how to

process I-130 at TSC, nobody can give a real answer BECAUSE NOBODY KNOWS

YET REALLY WHATS HAPPENING AT TSC YET. TSC MELT DOWN IS OCCURRING NOW

Nobodys giving you a real over view of what going on. So we have to wait.

Its possible USCIS is having there website updated so it wont be attacked

or over loaded with inquiries and lock up.

We all have to just wait it out until the outcome.

Nobody talking anyplace, USCIS and phone locations are giving you what

ever story because even they dont know.

We have to just wait it out and complain more and more . . .

I would recommend that all of us that are stuck in the TSC Blackhole to contact your local media, TV & print, to whomever covers Human Interest stories or Government #######. Call and write. Be sure to provide a link to this thread as well as others that are pertinent, i.e., filers to CSC after us that have been approved, etc, etc.........Provide copies of all correspondence that you have received during this fiasco to give merit to your story.

Maybe we can get some traction on this. Being in SoCal, the media doesn't give a rats #### about immigration issues so I have not had any luck.

I found this thread: VSC transfers to CSC in January 2008, Please post here Just looking breifly, most of the posters were approved in less than 45 days after transfer.

Here is one of their timelines:

10-10-2008: I-130 Sent

11-14-2008: NOA1

01-13-2009: Transfer to CSC

01-30-2009: APPROVED!!!!!!!!!

I found a few other random post but nothing approaching the size of our Nov 2010 CSC to TSC transfer.

I mean...what's the big deal..why everybody who (unfortunately) filed in July needs "additional review"...i guess they have qued all ov us from Nov2010 to additional 5 months mark...otherwise what else it could be...CSC couldn't deliver in 5 months(i wonder only for july filers)...either we are getting approvals soon or its another 5 months..thts the simple thing i understand..do we have any past "transfer" scenario on VJ and the outcome of that....

Laurel Scott has another chat scheduled today at 11AM CST. I'm wondering if one of you could post another question. I cannot because, although I registered I'm not added to the forums yet. Something like,

"Many June/July/August 2010 I-130 filers were transfered from CSC to TSC in early November in order to "speed up processing" and are still waiting. Apparently, there was 0 capacity for TSC to begin working on I-130 at the time of transfer and 0 to no capacity today some 80 days after transfer. (We've noticed a handful of August approvals last week, no June/July approvals). Many of us are 6 or 7 months post-NOA1 date by now, still waiting. Response to inquiries at TSC range from "wait another 60 days" to "wait 7 - 9 months". Meanwhile CSC is approving September/October petitions. While USCIS may be swamped, it seems they should still be required to followe their "first-come-first-served" mandate. The decision to transfer I-130 petitions that were 3-4 months old to another Processing Center that did not have the capability to work on them to me seems like negligence. Is there any recourse for those families affected?"
