We have the same faith, my daughters petition approved December 29, according to the letter received by my husband it will take 90 days? How true? My petition is also in the process of approval since TSC asked my husbands previous wife's death certificate.....how long will i wait? :)

I gave up a long time ago trying to figure anything out concerning TSC. My petition was approved 11/23, and have yet to receive NVC case number. God willing, our journey will soon be over, and we will be re-united with our families. Sometimes I feel like giving up and moving back to the Philippines, but I know this is not the smart thing to do for my daughters and my wife. Hang in there!!!

TSC exist in a parallel universe, and are subject to their own laws. I am SO bored of the lack of action. If we have movement on any case today, I'll be happy.

I hope God whoever he is, adds a year onto all our lives at the end to make up for this.

5 months are up for me today. I mailed 2 letters out today, one to my senator and one to my congressman. I mentioned the 36,000 cases being transferred from California which are effecting 72,000 people. I mentioned how California is currently adjudicating September and October files. I even mentioned how TSC is telling everyone that we are supposedly not outside processing time. I mentioned the reason for the transfer was to SPEED UP and how that turned out to be a nightmare, etc. etc. etc. It was a full one page letter. Will keep you guys posted when I get replies. Keep hopes up everyone.

Wouldn't that be individual's priority date (printed on NOA1) a date from which the clock begins to count 5 months and not the actual NOA1 hard copy rec'd in the mail? Please advise. Thanks.

It should be the priority date, but for us The TSC REFUGEES it is whatever they decide

from my understanding they look at the Notice Date,,, even on the transfer notices that we all received it has the NOA1 date written as Receipt Date and it doesn't have the other dates that we all had on our first notice

Hmmmmmm, how about posting the edited contents of your letter so some of the other filers here can use it as a template. I have already done a letter to my Congressman, it is on my laptop which I do not have access to until this weekend.

BTW, I have had NO response from the Ombusman (it was an e-mail, didn't know about the form until after I sent it) or my Congressman. I have sent e-mails to local media but nothing has gained any traction yet.

Ditto on that. I've sent emails to various sources, but the only one to come back was from our senator - who were VERY kindly informed by TSC that, we were not late for approval, as our NOA1 date was November 30th. We then had to go about PROVING to our Senator, we were not lying, and had to send hard copy faxes of everything.

This is costing us all time and money - I'm really surprised a class action lawsuit hasn't been taken by someone with more brains than us.

I attached a copy of my transfer notice to the letter I sent to my senator to make sure he had proof of what was going on. I'm expecting a b.s. response letter to my service request sometime this week since the agent I spoke to said I would receive some kind of notice of action within 30 days. I'm really curious to hear what they'll say when I call next week (when those 30 days are up).

I'm sure there will be no end to the service request upon service request and the BS.

I've about given up, and just resign myself to waiting for an approval. It seems NOTHING any of us do will lead to anything. We even had a letter on behalf of President Obama which we faxed to them, but nothing has come of it.

They a law unto themselves, it's a black hole - and while I'm confident we'll all be approved soon, it will be at THEIR pace, and not ours...ughh headbonk.gif

BTW, I have had NO response from the Ombusman (it was an e-mail, didn't know about the form until after I sent it) or my Congressman. I have sent e-mails to local media but nothing has gained any traction yet.

I sent a letter to my Congressman, John Sarbanes of Maryland, today as well along with, privacy release forms and all sorts of supporting documents. I also mentioned the 36,000 other cases transferred to TSC. It's not the best letter because I have a million things to do and I'm completely stressed out and missing my wife dearly right now, but I'll post it to give you guys an idea. Hope this helps:

January, 17 2011

Dear Congressman Sarbanes,

My name is Sean Patrick Carmody. I am a US citizen by birth and a 10 year resident of District 3 residing in Annapolis. I write you today to bring to your attention the horrible situation that my family and I are in thanks to the US Citizenship and Immigration Services.

I met my wife, Ana Celina Lopez Flores of Nicaragua, in Central America in January of 2009. It was love at first sight and I love her more and more everyday. A year later, I filed an I-129F petition for a K1 visa on her behalf and proposed marriage to her. She accepted and we got married on June 8, 2010. Six days later we went to the US Embassy in Managua, Nicaragua for my wife and her son’s visa interview. We were told that she was not eligible for a K1 visa because we were married and that we would have to start the whole entire immigration process all over again because USCIS would not let the Embassy in Nicaragua change our case classification from a K1 visa to a K3 visa. The more than $1,000 dollars that I spent in the process were lost and I had to pay the filing fees all over again when I filed separate I-130 petitions on behalf of my wife and her son.

I filed the I-130 petitions with USCIS at the Chicago Lockbox Location in July of 2010 and my wife and her son were assigned USCIS case numbers (Ana Celina Lopez Flores WAC1090177192, and Brayan Josue Cruz Lopez WAC1090177191) and given a priority date of July 18, 2010. Then on November 3, 2010, I received a notice stating that my wife’s and her son’s case were transferred to the Texas Service Center. The last correspondence that I’ve had with USCIS regarding these cases was on November 24, 2010 when they sent me an email notice informing me that my wife and son’s cases were being processed at that time.

It is now January 17, 2011 and I have yet to receive any type of communication from USCIS. According to their website, USCIS processes I-130 petitions within 5 months. I have now been waiting for 6 months with no response. What is even more disappointing is the fact that other people who filed their I-130 petitions in September are already receiving their second Notice of Action from USCIS informing them that their petitions have already been approved. How is this fair? I filed 2 months before them, yet their cases are being processed first.

I would really like to get this whole immigration process done and over with. I am teaching Spanish full-time at UMBC this year, taking my comp exams this week, and finishing up my Master’s degree. This whole immigration process has been a nightmare for me and has caused a lot of stress when I already have enough things going on in my life right now. I have been trying to get my wife a visa for over a year so that we can live together and start a family here, but it seems like I’m paying a very high price for trying to things the right way, according to the law.

After the two horrendous experiences I’ve had with USCIS trying to do things legally, I am completely frustrated, emotionally drained and almost entirely out of hope. That is why I write to you, Congressman Sarbanes, in the hopes that you can help me out with this matter. I have already written to President Obama about this matter, but his office simply forwarded the letter to the State Department who sent me a response telling me why my wife’s visa application was not approved and that I needed to file all over again, which I already knew. The people at the USCIS call center are not very helpful either. They give a different answer every time you call. I really feel like nobody cares about the way USCIS is unfairly treating me, my family and the 36,000 other people whose I-130 petitions seem to have been forgotten after they were transferred to the USCIS’s Texas Service Center from California in November of 2010. I sincerely hope that you can help my family and me with this struggle that we have been in since December of 2009. We are tired of being separated and unable to make any plans for a family or a future here in Maryland because of a visa.

I appreciate you taking the time to read this letter, and I will anxiously await your response.

Sincerely,

Sean Carmody
