You have to be legal in the UK for over 6 months to do a DCF. Personally, I'd hang on in there, but it's up to you. I have also heard they are keener on the sponsorship requirements on a DCF.

I still have a visa for the uk so that wouldn't be problem. we also have a joint sponsor, but i guess its just the feeling that our lives are always on hold. we have been married since 2007 and we are still not settled

i guess we just wait, and wait and wait

I TOTALLY hear you.

Val & I have been together since 2007, and married last year. Like you, we have had no real stability. It's like PAUSE has been pressed on our lives. And then, to get stuck, unluckily, in this TSC mess is so frustrating.

Life is too short to be away from a loved one, but I am more optimistic than ever right now. We are SO much closer than we were in July, and approval could happen ANY day. Keep pushing USCIS, keep pushing your senator, congressman, the Whitehouse. It WILL come soon enough.

We're both UK/US husband & wife, so, in roughly the same position. We WILL get our break soon.

Keep the faith.

As I said before. The horse is out of the barn for the June/July filers. Now it's damage control on the August petitions.

absolutely agree here... when filing in july for a 12 year canadian stepchild whose father got his greencard last year, we assumed he would be finishing the second half of 7th grade here (i.e. here by now). it hard to get excited when we haven't even gotten thru this first STEP by now, which should be such an easy step, especially when they already scrutinized my marriage, etc. last year during my husband's process. all we're doing now is bringing over a 7th grader from neighboring canada. really trying to stay positive, but now i'm actually concerned that he won't be here by summer. and we have an approved expedite. how is this okay?

let me try again... i need to put positive vibes out there in the universe, not negative... :)

absolutely agree with the person who said their spouse should BE here by now v. waiting for NOA2 at this point. when i filed in july for my 12-year old canadian stepchild whose father got his greencard last year, we assumed he would be finishing the second half of 7th grade here (i.e. here by now). it's tough for all of us that we haven't even gotten thru this first STEP by now, which should be such an easy step. the real work is in the NVC. here's putting positive energy out there in the world for all of us June/July filers to get to NVC quickly.

you think my letter was an automated reply? You guys all got letters after your service requests that said specifically " your case needs additional review and if you havent heard anything or received a Notice of Action in 9-12 months from this letter, please call"

Im thinking that something triggered in depth background checks...I sure hope this is a generic letter.

7/2/10- NOA1

2/9/11- NOA2 (transferred to Texas)

NVC

2/28/11- case number received

3/2/11- Paid AOS bill

3/5/11- Paid IV bill

3/12/11- expedite to Bogota consulate approved!!!

3/14/11- left NVC to Bogota for further processing

3/17/11- received by Bogota, emailed consulate and was told to send DS-230 and DS-2100 (packet 3)

3/18/11- packet 3 emailed to Bogota consulate, email confirmation on March 23

3/31/11- Interview date! Approved!!!!!!

Keep the faith, everything works out for the very best

Seriously, I would NOT worry about this. TSC are sending all sorts of wrong emails/letters out. There are standard templates of letters, and we are sent varying ones out just to get us off their back. We had one saying they needed more time as we had been sent for a "review". One letter said to wait until April, then we get a letter saying it's on an examiners desk.

And yes, a few DID get the same letter as you with differing timescales on them. It's just BS.

Don't worry, don't panic. I would totally disregard the letter.

just read TheSahlis service request letter and it seems to be following the same trend...are they just throwing out any type of answer to us or what?? His said 7-9, mine says 9-12...I have no idea what to believe from Texas. USCIS has screwed things up badly, caused me a bunch of pain last night, but now I feel much better. I hate them for playing with peoples lives like that, any misinformation will cause a lot of pain and they should realize that.

I'm not the one to keep smiling. You know that the average time between NOA2 and Interview is 180 days? I know that when I receive the NOA2 somehow I'll be even more angry than before. Right now I am just just running on anger. I don't think we should sit here eat ####### and smile, I feel like we should be taking action beyond just writing letters. We are the ones who get affected, not USCIS, not the Senators or even the President. Nobody is going to make it better for us. We have to find a way to do that ourselves. Do we need 3 separate government organizations in order to give a person permission to enter the country (USCIS, NVC, and Consulate)? The system is broken and people need to be made aware of that. When I tell people it takes around 1 year to move a spouse of a US citizen they are shocked, but they go right on eating their lunches because it does not affect them directly. We're being punished for following the rules, to me it is akin to putting an innocent person in prison. There is no oversight on USCIS and their needs to be.

Exactly. I think they are trying to get breathing space to get this work done. Service requests and complaints must be slowing their procedure down. They want us off their backs so they can work. I don't know whether to BLAME TSC, or feel sorry for them. One things for sure, the person or body who THOUGHT of this transfer needs a severe shake down! headbonk.gif

I agree, but anger is not doing us any good. We need to be putting those emotions into action. We've certainly been pro-active this week, and I am sure you have.

The system IS broken, and it is in need of severe overhaul.

will be calling again on Monday, and will let you all know what happened. How do they expect someone to wait 9-12 months after waiting 6 and a half months?? Good joke USCIS!!! You wait for a year and a half without your wife/husband and get back to me (without pay, this isnt the military)...let me know how that worked out for you! Please don't call me before your timeframe is up.
