I have never posted here but have actively browsed this site and especially this thread...I too was transferred to texas on november 2, 2010 and had started in california with me mailing it on august 6, 2010.I became frustrated like many here and was beginning to lose hope and faith in this bureaucratic bullshit, so I mailed my congresswoman and her aide wrote them and received this email and got this response:

Dear Mr. ,

Our office received below response from the Texas Service Center. I hope this information helps you. Thank you

Mr. ‘s I-130 petition, WACxxxxxxxxxx, xxxxxxxxx- will be requested to be worked ASAP. Please allow 45-60 days to receive a decision or other notice of action.

Thank you for your inquiry and please do not hesitate to contact us again if you have further questions regarding this case.

so ASAP did work because two days later I received approval. noa2 date of jan.13, 2011:

On January 13, 2011, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283

HANG IN THERE EVERYONE..it gets better.especially when today is my birthday and I found it this morning.

As I said before. The horse is out of the barn for the June/July filers. Now it's damage control on the August petitions.

anyway.. this is just MY theory... i've seen sneaky things from lazy co-workers who would rather switch the week something came in than just do the claim and i'm seen supervisors worry more about employee stats than the actual work getting done in the order it should been. the more i see here the more i believe that's what has been done to us, so i DO believe we will be approved by Feb but i'm angry because my husband should have been here by Feb.

The problem is that filers, as a group, are ignorant of what is going on. Except for discussion forums on the internet, there is no way to know what USCIS is really up to, for example approving August/September/October petitions before June/July petitions. When I brought this to the attention of the Tier 2 CS rep, he said "Different petitions take different times, no petition is identical." That may work for an individual, except when 100 or so filers pool information and notice a trend. 6/6 of the last petitions approved were all from August and no June/July approvals? Unless 80% if those transfered were August filers, something is wrong here and we are powerless to do anything about it. They say they process things in order, but they really process things in the order that suits their internal purposes. This is a problem of lack of transparency. At the very least the petition type and the dates they're approving day by day should be public information so we know they're doing their job as mandated.

I'm a government employee and I'll tell you I'm more pissed than you are because USCIS is giving us a bad name.

so did I....but I'm sure it was only a delay tactic....there way of saying we are working on it please don't bother us we are very important government employees and cant be bothered truly helping you pleblians....then when we get approved in 60 -90 days they can feel like we think they have worked hard for us poor saps...being in IT i am very used to this longer than needed time estimate....

Ok Let me try (not sure if it will make sense but this is what i think):

In the instructions, it recites "Person preparing this form: Indicate whether the preparer of this form is the person the case problem is about ("the subject"), an organization, attorney/representative or whether you are completing this form in any other capacity (such as a friend of the family, friend, uncle, etc.). Important: If you are the beneficiary of an immigration application and the one submitting the case problem, you will need the consent of the individual who submitted the petition on your behalf ("the Petitioner"). In this case, you are (although the beneficiary) simply a representative of the Petitioner, and will need the consent of the Petitioner to submit this case problem (please see also Section 15)."

From above it seems like even if beneficiary fill this form they are "representing" the petitioner, then I think petitioner is the "subject". So for 1-6 I think petitioner's info go there. For No. 7 I would pick option a because I think I am seeking immigration benefit to bring my wife into US. Then leave 14-15 blank (If you are a petitioner). Finally, fill your info (Petitioner) in 16-17 (Note: instruction for 17 recites, "If you are an attorney or representative, you should sign your name. Otherwise, the subject should sign his or her name.")

before i posted i had done exactly that thing too... had benefiary info listed, then changed 1-4 to me (petitioner) but when i got to 17, got confused.

it says subject should sign. and "declare" (spelled incorrectly) that i have prepared it at the request of the person named in 14

when you look at 14 it looks like the petitioner should have info there, and only fill out 1, 2, 3, 4, or 5 and signature if they apply, otherwise sign at 17.

which would put us back to putting beneficiary back at original 1-4 which makes sense becasue they are the ones who are seeking the immigration benefit.

otherwise where are both beneficiary and petitioner info listed...

i am usually very good with paperwork but maybe it is lack of sleep. i am giving this thing a second look today and STILL going :blink:

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 9-12 months, please call customer service at the number provided below.

9-12 months??? Im withdrawing my petition..

7/2/10- NOA1

2/9/11- NOA2 (transferred to Texas)

NVC

2/28/11- case number received

3/2/11- Paid AOS bill

3/5/11- Paid IV bill

3/12/11- expedite to Bogota consulate approved!!!

3/14/11- left NVC to Bogota for further processing

3/17/11- received by Bogota, emailed consulate and was told to send DS-230 and DS-2100 (packet 3)

3/18/11- packet 3 emailed to Bogota consulate, email confirmation on March 23

3/31/11- Interview date! Approved!!!!!!

yeah, my life just basically went to ####### once I heard that. There is no way I am going to continue to wait...guess its a sign that I should stop. Also, cant do direct consular filing because I wasnt in the country for 6 continuous months ( I was in for 5, now am in for another)... I am just doomed altogether and completely devastated. Good luck to all of you, I hope you all get your approvals very soon.

On second thought, maybe you should send that to the Omnibusman and demand an explanation.
