I can only imagine how bad that feels, especially when you have a hard copy of expedite approval. Thats something we didnt get I dont think. ALTHOUGH we were told that even for an expedite to be processed, the uscis are allowed 90 days to adjudicate it. I had that info somewhere. Im pretty sure thats correct, I did think it was 60 days for a moment, but sure its 90.

Regardless of that, even so that would take you way beyond the processing time Gary. Ive said it before, and it drove my wife insane cos the uscis wont speak to the beneficary - so I had her calling every day almost. And sometimes twice a day. The info that we had was conflicting. To say the least. How someone cannot read info from a computer screen is beyond me. I know the Tier 2's can give info on specific cases, whereas CSR's arent meant to.

Actually thats another thing, and I know its already been said/discussed. Id be calling the uscis FREQUENTLY to sort this out. I know you guys do what you can. Has anyone spoken to the supervisor of a Tier 2 yet? We had to a couple of times to get the correct details, as the certain T2 could not seem to read!!

Val is on every single day to the point where she is absolutely drained. IF the clock HAS been reset, it could take us to April. No, I don't think we've spoken to a supervisor yet, and yesterday was impossible to get through. I expect there's 36,000 irate people trying to get through. The system is broken. I expect some of us to be transferred BACK to CSC before long....ughh...

Timeline

From TSC's perspective, these I-130 (many of them 4-months old) were dumped on them in early November. Why shouldn't they have the standard 5 months to work on them as with a new application? They don't care when our NOA1s are dated. This confirms the response to my first SR, "expect a response in 60 days". They see themselves as the victims here, not us.

More and more they are trying to pull the trick of saying we only applied on November 24th.

If this were in any other field of commerce, and this IS a paid for service, heads would roll! headbonk.gif

on this i want to say please copy all docs which state your dates... NOA1, any correspondence showing transfer, etc.

they also tried this with me, with several different dates, and honestly thought i would buy it! They even tried claming i was using my MAILING date when i was using my original NOA1 date

stand firm against them, they WILL keep trying to wear you down.

NO. never spoken to a supervisor of a tier 2 person.

i attempted twice... the tier 2 person pretended to put me through, instead put me into a voicemail system where she allowed it to play part of the greeting, then the call cut before it finished. when i called back (and got same tier 2 person) she hung up on me. LOL so much for her snotty "do you think we are just sitting here waiting for your call?" comment at beginning of first call because i guess she was the second time LOL

i understand about being drained... after 1.5yrs of waiting i am having some major issues and ready to snap. we expected a little extra delay because of his country, we didnt expect to just have our petition ignored. with financial, medical, family issues at times it's truly more than i can bear. he is begging me to come there and live and i'm terrified of that but he assures me that we will live separate from his family and he can protect me, but i now feel scared HERE, how can he protect me THERE?!

the stress is making both of us nervous wrecks... they are at him CONSTANTLY, and i am scared and worried all time now. i feel like our govt will not do anything until one of us is dead, then it will be too late.

we're just a number.

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

i do NOT agree

working in offices for many years, many which had "cut offs" (claims/forms come in and are date-stamped and are expected/required to be processed within a set time period) I can assure you that this CAN be done.

MANY times while working in one place that required a 30 day turn around we used to get dumped on during a 2-3 cutoff period almost an entire month's worth of work. And that was a private company. I have worked as a contractor in a govt agency as well, believe me when i say how frustrating it is for quick worker to work among not necessarily lazy workers but just unmotivated ones. they have NO incentive to work quickly. same pay whether they work quickly or slowly, BUT the more they do the more chance they have of getting into trouble for a mistake they've made so actually they ARE rewarded for going more slowly (or so that was how it was explained to me, which was such BS to me so i ignored them LOL! i also ignored a lot of things which made jaws drop but there was work to be done!)

Maybe we should also be directing our emails and complaints to CSC also, as it was THEY who sat on our petitions for 4 months.

You tend to get a lot more sense from the folk in Washington, though.

Not sure how helpful they will be in the current climate, as the mess at TSC will obviously has some sort of effect on the NVC.

If the clock was indeed reset, then wouldn't that be a USCIS error and qualify us for expedition? How do we argue this without waiting until April to prove it? Otherwise, what is the point of having a processing time limit if they can just extend indefinitely by transfering it around the country?

I think the evidence would be the letter we all got:

Your case has been transferred to TSC TO SPEED UP PROCESSING...

How we'd get through to anyone on this is beyond me though. The Ombudsman may be the best avenue - I mailed him earlier, maybe we should all mail him with our grievances.
