I'd also encourage people (beneficiaries) in other countries to write to their local government. Their government CANNOT have any influence over the uscis obviously, but they in turn will write to the specific country where the actual US Ambassador is, and he / she can contact the uscis and find out what is going on.

Whether it will work in all cases/countries, Ive no idea, all I can tell you it helped in our case. With the US Ambassador to London contacting the uscis and informing them of the situation.

Laurel: Having your case transferred from CSC to TSC is not a problem. In fact the reason they do it is to process your case faster. There's no reason to be upset about it. You should instead be thankful.

I-130 petition for my spouse was received by CSC on 07/27/2010, and was transferred to TSC on 11/03/2010. I received I-797C approval notice from TSC dated 11/23/2010. Received a letter from USCIS, in response to my service request, on 12/23/2010, stating: "Your application was ordered approved in November, However, the processing is not complete. The application has not been transferred to the National Visa Center, and the approval letter has not been sent. A request has been made to the adjudicating officer to complete the processing of this application". Was my petition approved by mistake? What sort of "processing" takes place at the service center after the petition has been approved? I understand that thousands of petitions were transferred from CSC to TSC ostensibly to "speed up processing". Do you have any insight as to what could possibly be happening with my petition?

Laurel: It sounds like the individual adjudicator made some sort of behind-the-scenes administrative error. He may have forgotten to sign something or forgot to enter something in the database or something like that. You may never find out what he forgot to do. This sort of thing is not unheard of. There's not much you can do about it. It's human error.

Iminca: from Xelance: You may have already answered this from DanTes question..but here it goes. Do you know what is going on at Texas Service Center? Does the 5 month processing time really start over if your case is transferred to a different center? I was originally a California Service Center filer with an NOA1 date of July 2nd and was transferred in November along with many other petitions..I have yet to get my NOA2 6 months later, while California Service Center September filers seem to be getting theirs already. Have you got any word about what happened there and WHY they decided to transfer us instead of September/ October filers? What a horrible, unthoughtful move....Thanks for any insight you can give us!

Laurel: Have you ever been in a traffic jam and you switch lanes because the next one over is moving faster. But then as soon as you get in the other lane it slows down and the one you were just in is moving faster. CIS was trying to move your case along faster. It didn't work out, but the move was not horrible or unthoughtful

rich: Laurel: reading on various websites theres so many petitions been passed to TSC from CSC. I know the objective was to speed things up, but its not worked. Have you any idea what will happen, a lot are July filers for Spousal visas, were told they'd been approved in Nov/Dec - but have not received their hard i797c notice, nor does the nvc have record of them. do you think the good idea has lead to a major problem with Texas SC?

Laurel: Wow, lots of questions about this. If it's an entire class of individuals and not a single case wherein an office-wide error has occurred, then I would presume CIS is aware of the problem and I would give them a little time to resolve it. Your attorney can check with the AILA liaison for TSC to get more information. I'll see what I can find out and I will post it on the 'news' section on the main page of my website.

I noticed that Laurel gave a standard "USCIS like" answer for the 1st two but on the 3rd one she started to see that it was a system wide problem and plans to look into it. :dance:

i was on the phone in a flash this morning, even though my issue was from months ago, i reported an officer who was QUITE nasty to me during TWO calls (personal attacks on me right from beginning of 1st call - guess she didnt like my name? the country from which my husband hails? IDK!)... what are the odds of getting the SAME horrible tier 2 person two calls in a row.

THAT is why you always get their name at beginning of call ;) usually they're nice but every once in a while you get one who thinks their govt job security gives them the power to be a tyrant :ranting:

if you gave your info (receipt #s, full name, etc) to anyone on VJ under the guise that they would "help" you through the immigration journey with his inside contacts (like his sister at USCIS) ... please contact OLUInquiries@dhs.gov, and go to http://www.whitehouse.gov/contact to report anything suspicious. Contact your congressman and senator's offices as well.

Yes, it appeared she knew nothing about the current debarcle. I was really hoping she knew about it, especially as she isnt based too far away - but apparently not.

So, she#s put in writing in her chat she will try and find out more, and Im pretty sure she will. She's an immigration lawyer that is very well respected, and although Ive not used her services directly, her chats have been a godsend to me. I came across that forum by accident, and if Id not followed her advice, I would have been in a mess I think, so rather than promoting her services, I prefer to think of it as a channel for you guys to get some help and at a cost of nothing apart from typing questions out.

If you stick with the proactive movement that appears to be building up quite a pace now, it wont be long before the news stations pick it up, politicians take note etc...

I think TSC is trying to make it that way. That's what they told Val's senator & that's pretty much what it says on the automated customer service line (please wait 180 days from the date of transfer to inquire about your case...).

Just to put you straight on that Richi, we all got letters around November 4th stating we had been transferred to TSC to "speed up processing". Most of us called USCIS just after that, and were informed in no uncertain terms that the clock HAD NOT been put back.

Just recently, there seems to be a movement coming from TSC that the clock WAS reset - but not to the date we were transferred, but to the date THEY in-putted the petitions on their system - that is November 24th 2010.

Numerous people have been told that their petition was "one week away", and that TSC are working on "17th July" right now. Hell, we even have a hard copy expedite approval on November 26th, as has Sqdgns. Not forgetting DanTes & U&S who were approved yet "unapproved" a week later.

My gut tells me we HAVE been reset, and jenny's Senator was correct in that 36,000 I-130's were sent over in November and TSC were given 5 months to process....UGHH...headbonk.gif

I can only imagine how bad that feels, especially when you have a hard copy of expedite approval. Thats something we didnt get I dont think. ALTHOUGH we were told that even for an expedite to be processed, the uscis are allowed 90 days to adjudicate it. I had that info somewhere. Im pretty sure thats correct, I did think it was 60 days for a moment, but sure its 90.

Regardless of that, even so that would take you way beyond the processing time Gary. Ive said it before, and it drove my wife insane cos the uscis wont speak to the beneficary - so I had her calling every day almost. And sometimes twice a day. The info that we had was conflicting. To say the least. How someone cannot read info from a computer screen is beyond me. I know the Tier 2's can give info on specific cases, whereas CSR's arent meant to.

Actually thats another thing, and I know its already been said/discussed. Id be calling the uscis FREQUENTLY to sort this out. I know you guys do what you can. Has anyone spoken to the supervisor of a Tier 2 yet? We had to a couple of times to get the correct details, as the certain T2 could not seem to read!!
